LOVE THY SHEPHERD

by LOVE THY SHEPHERD on 24 December 2012 - 03:12

Someone is posting puppy ads on database and they are using my dogs pictures.

http://www.bluepanther3.com/ourpuppies.html

I do not know this person and they DO NOT have my permission to use
any of my dogs photos.  They are falsely advertising on pedigreedatabase
stating my dog is titled and is the sire of their litter.  I  have emailed them
many times today asking them to take my dog pics off and they refuse.

under the classified section, US  puppies for sale

second or third page as of now,  a sable puppy sitting in a red chair
and the ad is for  show/work puppies and when u click on the website

my dogs pics is the one on the top right

CAN U HELP

We Cannot tell people what or whose pictures they can or cannot use.  Anyone who posts a picture without a copyright or atleast a watermark to identify it will run the risk of someone else using it.

There is no proof that the picture is yours.

May I suggest that you post your picture and their picture as well as the links to it and show us.

I have not seen either picture but an innocent picture of a puppy any puppy just can't be that big a deal.

It's not the puppy picture.  On this persons website they are stating that my dog is the sire
of the litter.  I don't know these people.  Is there some way I can send you the email this
person sent me ?

My website is  www.germanlinedogs.webs.com   DACH HAUS GERMAN SHEPHERDS
My male is Ghost vom Waldestraum I have several pics of my dog.  They somehow got
my dogs pictures and put him on their site.  This is false advertising.

How do I copyright a picture ? Their site is  Blue Panther German Shepherds.  I just found this
out today, someone emailed me and sent me to their site.  When you go to the site and go on
the puppies page, it shows a picture of my dog as the sire.

Donna, if they were using a picture of your dog, they must have removed it since you posted all this, because I've been all over their site, and cannot find ANYTHING as you describe.

When I go to their 'puppies' page, I see a picture of their bitch, Dori, lying with her babies on a quilt with daisies on it; alongside that, there's the name of the sire of the pups, Counselor v Haus Dooling, under which there's a picture that appears to actually be of their dog Azlan doing bite work in a stadium [the picture is included in Azlan's gallery page, and is titled 'azlan_btework' if you right click on it, and then select Properties]. Then there's a bunch of puppy pics, and there's a photo of a black & tan dog under a heading "Past litters" with a caption 'DorixMarco'.  Don't see anything that looks like your male, Ghost. No mention of him as the sire of anything of theirs, either. Not in their ad, not on their page.

So either you were mistaken, or they've removed the picture, and you just didn't refresh your browser to be able to see the new page. In any event, it would appear your complaint has been resolved by the individuals to whom that web site belongs.

If you took the photograph, you have copyright protection on that photograph.

"Copyright protection subsists from the time the work is created in fixed form. The copyright in the work of authorship immediately becomes the property of the author who created the work".

"The way in which copyright protection is secured is frequently misunderstood. No publication or registration or other action
in the Copyright Office is required to secure copyright. See the following note. There are, however, certain definite advantages to registration".

Doesn't really matter when one can't prove they took the pictures.  People will happily steal photos and not remove them from advertising.

A link to the ad would be nice, I don't have the time to search it out.
