OP- in one of the emails you posted the breeder stated he hadn't cashed the check yet. Is this still the case? If so soak up the $30 bank fee and stop payment on the check and be done with it.

Bob has returned my deposit and made this situation right.

Thank you Bob.

Maybe a thread claiming a retraction of ".....is a CROOK" is in order to really make things right. Something like...I WAS WRONG! BOB KRESS IS NOT A CROOK!
I don't know him, never heard of him, but smearing is smearing.

joanro but this is what she had to do to get her money back.  This is what it took. Being nice didnt get her anywhere. Being nice doesnt seem to get anyone anywhere anymore. Did it get you far in your past problems with breeders or brokers?

Don't know this breeder and never dealt with them, but the name sounded familiar because they had some ads in the past year for a female for sale name Choi?  She was for sale for $800, then a few months later they had some ads for pups of hers selling for $3500 I think.  Seemed odd that a dog worth only 800 could produce pups worth 3500....?

I see good people with poor business processes and bad people manipulating the process.  Some of you guys have no idea of the potential for your kennels and others are simply dreaming.

There is a need in this market for a consultant.

I am not sure on the terms of their agreement, but from what I have taken from the situation is that Bob sold Choi (Myers` Quick Choi) to a young hopeful breeder or  his mother (Facebook name of Cee Kinsey of von der Kinsey gsds) and he is now breeding her. Currently he has a litter with her of only 2 pups. They are advertised on his personal Facebook account for $5,000. The reason for the increase was because of there only being 2 pups (made a statement after she was done  whelping that price would be adjusted for the low number). Also because the pups sire (Inde von der Bleuhaus) was killed by another dog in his kennel in a fight. Cee currently resides in Sheboygan WI and is from Warsaw Indiana. There is a lot more I wouldn't mind sharing about this person and his training/breeding practices but that is off topic from the thread and not relevant to Bob, other than the agreement/partnership/or whatever that they have together. If interested please pm me, as my intent is not to draw large attention to a very small breeder.

I'm not taking sides but people who aren't lawyers shouldn't be offering legal advise

"IMO all puppies should be sold with limited registration until a minimum of hips and elbow can be certified, and some kind of title or proof if training can be established."

Examples of the last 2 breedings on website....... http://www.pedigreedatabase.com/breeding.result?father=1325902&mother=718137 and http://www.pedigreedatabase.com/breeding.result?father=1325902&mother=718137 seems like there's a whole lot of missing info in the pedigrees......

How are these breedings improving the breed? What is the goal of these breedings? http://www.boyettegermanshepherds.com/photo-gallery.php

Vauge contract which is easily denied...... sells "fullly regtistered puppies for 800" . this is contributing to the oversupply of dogs in shelters.
OFA doesn't certify hips/elbows until 2 years, so guaranteeing against "congenital defect" to one year is a non-guarantee

If the dog is spay/neuter why require akc papers to be returned? even a mildly displastic dog can compete in rally or obedience but not without papers.

"The buyer has 72 hours to have the puppy examined by a licensed veterinarian. During this time only may a cash refund be granted. A written report attesting to the poor health of the dog or a statement of euthanasia must be provided by the veterinarian. Shipping expenses are not refundable.

The dog is guaranteed against congenital defects until one year of age. A replacement will be given after a report of neuter/spay or euthanasia is provided by the buyer and AKC registration is signed back over to the seller.

Male puppies sold as breed quality are guaranteed to have descended testicles by 6 months of age.

No further guarantee is made. If requesting replacement for any other reason than congenital defect, the dog must be brought to the seller for evaluation. If replacement is given, AKC registration must be signed over to the seller. Replacements are of equal value and same sex when available. Temperament is not guaranteed. Reproductive capability is not guaranteed.

The puppy will be named with the litter letter as the first name and "von Boyette" at the end in keeping with the German standard.

The buyer is responsible for all shipping expenses whether for the original or replacement puppy.

The seller is not responsible for accidental death or injury once the dog leaves the seller's premises. Under no circumstances will the seller be responsible for veterinary expenses for the dog after the buyer has purchased it.

This contract applies to the original purchaser only and is non-transferable.

This contract is under the jurisdiction of the State of Kentucky, in the county of Spencer. It is agreed the place of venue shall be in Taylorsville, Kentucky.
