BIG DIFFERENCE, Katy, between calling police to see about getting your money back and calling animal control. Calling animal control on someone because you're angry is despicable, hence the reactions to that statement. I'm sure, since you have multiple dogs, you can understand how angry you would be if someone reported you to animal control with no grounds, simply over a personal dispute. That's just a low blow. Very glad you did not do this in this case. 

I am going to weigh in here after reading this the thread. From a legal standpoint bob I would be careful about stating "she is absolutely crazy". There is a term called libel. 

The other thing I would comment about was if you still have the deposit and she is still a willing buyer and you refuse she could take this past the small claims court she could also sue for any lost revenue from potential pups/matings. 

I don't know either of you and I am just speaking from a strictly legal standpoint. 
Mnow from your legal stand she has called you a crook. You may have a libel case against her possibly but doubtful because you have held her deposit while she is stating publicly she was still a willing buyer and you apparently have now refused to complete the deal. That weakens your case against her. 

On a criminal side this could get very bad because if money was mailed or wired it could be considered mail or wire fraud If you refuse to complete the agreement. In absence of any written contract that allows you to back out for any reason and no refund the money this could become very sticky from a criminal standpoint. 

Again I know neither of you and am only speaking from a legal opinion stanstandpoint best thing for all is to return the deposit and ask the mods to remove the thread

One thing is real clear. khlewis, you are a crook. And I mean a criminal. You deliberately filed a false report with animal control. This is a crime in most places, just like it's a crime to file a false police report. You already said on a public forum that you did this, so you committed a crime. If I was the breeder, I would ask that criminal charges be brought against you for doing this. I would also sue your ass off if any harm happened to me or my family or my dogs because you did this crime.

I guess someone wised you up about this because now you're denying you did the crime that you already bragged about doing. And all of a sudden you're talking real polite instead of rude. Well it's too late now. Don't bother editing your earlier posts because the permanent record will still be there for the police and the courts.

Anyone who would even threaten to file a false report with animal control is a piece of trash. I'm not a lawyer but this kind of threat might also be a crime like blackmail is.

I have not filed any report with animal control and anyone is welcome to call them and confirm that. I have filed a report with my local sheriff's department ONLY. they are taking things from that point. Considering that it was sent by mail it is a CRIMINAL act, so it falls under their jurisdiction, not animal control. Animal control was mention by Bob's wife. She stated to me in a voicemail that IF I called animal control on them that they would do the same to me. I have not done that though.

Thank you everyone for your input!  I have contacted the local sheriff department here in KY and their sheriff in MI.  I have also contacted their animal control officer.  The wife left me a message saying that if I contacted animal control on them that she would do the same to me.  My response to that is that is fine.  I have a kennel liscence and know my animal control officer and have nothing to hide here.

And you admitted in your 3:12 post today and your 18:12 post yesterday that you don't have any evidence that the breeder abuses or neglects his dogs. So you had no reason to even threaten the breeder about making a report with animal control.

JonRob, I agree on principle about what you're saying about calling animal control. I had a piece of trash do that to me because, well, they're trash and that's the kind of thing trash does when they don't succeed at their trashy plans. Animal control was told all sorts of preposterous things about me (breeding and training Pit Bulls to be "vicious", breeding Rotts, GSDs, and that the neighborhood children were in danger, blah blah blah). Utter hilarity, really, it's so bizarre and farfetched. I own ONE breeding animal, and one Pit Bull, who is not a breeding animal, period.  I have never had a Rottweiler in my life, and I myself have a 3yr old boy. Just total nonsense, but for someone else, who really had a kennel or did have dogs resembling this description, it could've caused them a lot of problems. Little did this POS know, I adopted a dog from this very AC unit less than a year prior, and the person they were speaking to was the one who facilitated the adoption, LOL! 

That's just something you don't do, no matter how angry you get at someone, if there is no evidence of mistreatment of an animal.

Jenni, that piece of trash is damn lucky she didn't go to jail for knowingly filing a false report with animal control. And that you didn't sue her ass off. Those are consequences that even trash understand.

khlewis, I'm no lawyer but you might want to see a lawyer that does criminal law about what you did to the breeder even if you did just threaten to file a (false) report with animal control. Looks like a threat to file a report with animal control unless someone gives you 200 bucks is blackmail:

18 USC § 873 - Blackmail

Whoever, under a threat of informing, or as a consideration for not informing, against any violation of any law of the United States, demands or receives any money or other valuable thing, shall be fined under this title or imprisoned not more than one year, or both.

I suspect things are even worse if there is no real violation of the law to inform on, only a false one like in this case. But like I said, I'm no lawyer.
