Firstly, why would you ever leave an intact male around a female in heat, unsupervised, for any amount of time?
That's accidentally-on-purpose encouraging giving them oppertunity to do the deed.
Secondly, of COURSE HE CAN GET HER PREGNANT, yes at that age, and yes with or without tie.
The tie just ensures his sperm stay inside the female for longer. I'm not sure where you read a breeding only has a 40% success rate. It's much higher than that, emperically between 83% and 90% for natural breedings. Testicles drop around 7 or 8 weeks, though until the ring closes at about the 6mo mark. He's had his balls down for a while now.
