As a person who was just recently scammed out of $4400 hard earned money, then was never shipped the dog, I know how it feels to get screwed out of one's money.  I think its a damn shame that honest people can't get a dog we paid for when money has been sent.  There are flaws on both sides.  I think the dog should have advertised as "non-breedable" right up front, not later after money was sent. I would be angry about that myself.  I've seen TONS of ads here where they say dog is neutered/not breedable/etc. That would have kept the OP from even inquiring about Orex in the first place, hence this never happening.   Thats what should have been said. I would probably have been just as angry/threatening if someone had my money AND the dog too. I know, it just happened to me!   I think the OP should get ALL his money back, less whatever small percentage in price it cost her to advertise him, get the health certif, and crate. That's sure not almost $1000

And Ibrahim, thank you very much and good post. One correction I'd like to make is I am a she not a he. As always I appreciate your kind words.

Agreed.  I fail to see where Bhall has lost much of anything.  Time, maybe, however, if you don't want to deal with customers, quit selling, simple. Crate can be used for next sale.

Yes, really.  One doesn't get to keep the dog and the money, you still have the dog, just resell him!  Yes I do think the ad should have said "not for breeding" and you wouldn't have this problem in the first place.  Sorry, just still a bit touchy about sending money and not getting a dog, so have to feel for the OP here.

This is what gives breeders bad names. One thing has happened, Breeder has money and Dog YEA!!!!!! What more can a breeder ask for.

GIVE HIM HIS MONEY BACK and suck it up.

I can certainly see both sides of this issue............I can say that $3500 is alot of money for me and I would be a bit upset that the dog I thought I had just bought was sterile. Ok the guy had some short commings with what he expected but the dog being sterile is kinda a big issue and it should have been stated up front before money ever exchanged hands. Jmo.

So the question for me is:  legally, unless it states in the contract that a pecentage of the funds would be retained if the buyer backs out, I honestly can't see how it would be legal to keep the money  (less the crate and health cert) no matter what the reason. If the poster did sue, you may be out more than just refunding what he paid less what you could actually proove with receipts. I suppose the advantage of the buyer being outside the US is better in this situation for the breeder. Sorry but if it were me and I thought I was getting screwed, I'd sue too. Just another instance of better to buy and exchange money in PERSON.

Cmills, that's not true. It should be, but isn't. This is what happened to me: I advertised a female on here a few years back. I stated in bold letters at the bottom of the ad:  NOT FOR BREEDING. I thought that was quite clear. She was cheaper than a brood bitch, since she wasn't being sold for breeding potential, though she had an excellent ped, was OFA excellent, and had drive out the wazoo. What did I get? I got scammers  trying to sell her on craigslist before I had even sold her, and I had a gentleman tell me he wanted a competition dog as a pet and housedog for his wife. He didn't have any other dogs at the time and she would be in a SchH/family situation, which was perfect. He had asked me why I said she wasn't suitable for breeding and I answered, which imo is clear acknowledgment that he was deliberately misleading me in order to get this dog and get her cheaply. 

When the truth came out, waaaay down the road, he's a "trainer" who wanted her to breed to a dog I would never breed anything to, let alone her, and the entire "wife's housedog" lie was to get me to sell her to a "good home" cheaply, because they knew I'm a sucker for a good home and often let it get in the way of money. Lies,lies, and more lies. He pretended to be short on cash, wanted a nice dog for the house, etc. etc....just nasty scum taking advantage of the widely known fact that I often let dogs go w/little or no money down, make deals w/people who are deserving but short on cash, etc. He saw dollar signs- ignore my wishes/warnings and turn around and use her for that purpose OR sell her to someone else w/out disclosure. SCUMBAGS CAN BE ON EITHER SIDE OF THE TRANSACTION! Sellers can and do get ripped off. 

That's all this is about...jumping the gun on accusations without looking at BOTH sides of responsibility. He said she told him the dog was sterile, or at least that he'd failed to impregnate 2 bitches. No one else was there for their conversations, so I don't know how anyone can take one side over another. I see major cultural/language rifts more than anything. Cool your jets when in doubt and give people a freaking chance before shouting about how awful they are to anyone who will listen.

How do you guys come up with the idea that I am trying to keep his money?  Why would I do that?  I guess you assume.  Don't assume anything.  
Cmills, question....is is not you that always emails me when you need help with papers?  Did you ever sell a dog named Puma Sunami?
Now, I am not keeping his money but HE IS THE ONE THAT SAID TO GIVE HIM $2,800 once I place Orex.  How hard is that to understand?
Crate and health certificate was never paid for.  Not worried about that.  That is why I didn't ship the dog because there was money owed.  He does not have to pay me for the crate or the health certificate but $700 is fair I believe as he was not advertised as a stud dog.
Orex has excellent offspring in Germany and honestly he has never been officially collected by a repro specialist.  If someone contacts me and tells me they are looking for a stud dog and competition dog I would certainly tells them right away that 2 bitches were empty.  If someone contacts me and tells me they are looking for a family and maybe sport dog why would I even think that they are looking for a cheap stud dog.  All he talked about was how happy they are to have a family member.  I thought Orex was going to be the only dog as he said "I USED TO HAVE DOGS"
He decided to purchase Orex a while back and I had to call the airline at least 6 times to change the name for the receiver as he emailed me daily with a new name for pick up.  This could have been resolved privatly but he chose to post on here not me.
