What color is his dam Erika? Is she bicolor or would you consider her sable.Her daughter from the same litter as Max may also appear to be black and tan while when looking closer,she is actually sable. - http://www.pedigreedatabase.com/german_shepherd_dog/dog.html?id=521732-linda-cerny-obelisk

Good question, Erika looks like a straight up black/tan blanket back, as does Linda. However the sire/dam listed for Linda and Max do not appear to be sable in any way...which would make it genetically impossible for Max to be sable.
What looks sable to you on Linda is just color of the undercoat showing thru the topcoat, and it's my guess that this is a photo of an adolescent Linda whose coat was still in color change transition, where the topcoat color in the thighs and shoulder were changing to their adult color of tan. She likely ended up a saddleback, not blanket back.
Someone either put up photos of wrong dogs, or those aren't Max's parents.

The mother looks black/tan, but if Max is indeed her son she can't be any color other than Sable.
A side note, the mother's front angulation isn't good al all, same goes for her daughter Linda
