Re: The Co-operation Agreement (UK)
dated 9th March 2013

The Kennel Club (TKC) and the World Union of German Shepherd Dogs (WUSV)
  Having carefully considered this agreement, in the context of the WUSV Constitution, I am entirely satisfied that the WUSV Constitution upholds their right and authority to make a Co-operation agreement with The Kennel Club (TKC). However, in my firm opinion, the WUSV have strayed from their authority under the WUSV Constitution, by the inclusion of Clauses 11 and 12. As follows:

11. Require clubs or associations affiliated to it which run events within the jurisdiction of TKC to submit schedules for those events to TKC for approval

12. Acknowledge that such events shall be subject to TKC disciplinary regulations and procedures in force from time to time.

The WUSV Constitution includes a SECTION 12, which clearly lays down the “Duties of the member associations”.
If the President and Secretary-General of the WUSV wish to make changes, amendments or additions in these Duties, then it is my firm opinion, they are obligated to pursue such wishes through the WUSV Constitutional “Members Meeting” – they are not entitled to make changes in respect of individual member associations duties otherwise.

Fundamental to Section 11 of the WUSV Constitution “Rights of the Member Associations” is the first sentence, “All member associations have the same rights”.
The ambiguous paragraph, headed: Problem Resolution   preceding clauses 11 and 12 within the above agreement, is a further indication of some spurious straying by the parties.

Therefore, in summary, my firm opinion is that clauses 11 and 12 of the above agreement are invalid.

Clause 11 emanated from clause 9 of the Kennel Club GSD Undertaking 2010, which the GSD League and other GSD Breed Clubs refused to sign. The KC had made it clear that any Club refusing to sign it would sacrifice their CC's (Champion Certificates). It was this that triggered the GSD League to initiate the Regional Events which are organised under WUSV Constitutional "Section 12" Obligations of member associations. The Kennel Club felt their monopoly on pedigree dog shows were threatened and have sought to bring these GSD League Regional Events back within their influence. It is obvious that the Kennel Club have grasped the "Co-operatation Agreement" with the WUSV to include clauses 11 & 12. - However in my firm opinion, the WUSV do not have the constitutional authority to agree to such clauses, and they should therefore be ignored.
