If he has a brown ring, I'd say he's a dark bicolor. I've never seen a good enough photo to really tell for sure. I've never seen a dog I knew was genetically black, but that had bleedthrough AND a ring under the tail. I tell bicolors from blacks at birth by looking for the tan under the tail.
