To my friends in the German Shepherd Dog World:

In 2008 I sent my male Ilay vom Nordkristall to the US to stand at stud for one year with Mary Gattone, an AKC Conformation Judge. When the time was up she requested an additional year and asked that I sign an AKC Power of Attorney so that she could sign litter applications and stud contracts on Ilay. He has many times been advertised in the WDA magazine for the past two years with me as owner and Mary Gattone listed as “Agent.”

When our agreement expired I asked that Ilay be returned to Holland in July 2010. After making this request, Mary Gattone used the AKC Power of Attorney to transfer Ilay into her name. She has ‘imported’ the dog against AKC and Dutch Kennel Club requirements with no bill of sale and no bescheinigung. AKC will do nothing to stop this.

As a result, I have blocked all Ilay’s paperwork through the SV and Dutch Kennel Club. Any puppies resulting from future breedings will not be recognized in Europe. Additionally I am moving forward in court to reclaim my dog. Once done, I WILL NOT HONOR ANY BREEDINGS she conducts while this is in dispute.

Ilay is my dog. He always has been and always will be. This scam to take my dog is condoned by AKC through their inactivity to assist me to resolve it. They violate their own policies to do so in that no bescheinigung was provided to authenticate the transfer – the sole reason for the bescheinigung.

I have received no stud fee money or puppy sale money since dealing with Mary Gattone.
She has, in effect, taken my dogs and AKC condoned it.
Mary took advantage of my (lack of knowledge of the forms from the AKC ( not knowing how the system works) she has always told me that it was only to sign the stud cards

Under his photoalbum you can see his papers that she sign on the 9 of august and i told her in July to send the dogs back this include also the 3 puppy's she is now not sending them either

Owner of Olay,

I feel sorry for the situation you are in and wish you take back your dog (if what you said above is true and all the story) bu I felt urged to ask, how come during all this long period you accepted not being paid for your Stud dog work? shouldn't that made you suspicious of the agent?

I'm so sorry to hear of this Yvonne.

I will make sure that everyone I know, knows that Ilay has been stolen by Mary Gattone who is a thief. I hope you can find a good attorney here in the United States to help you with this terrible situation.

My heart aches for your loss. I hope Ilay comes home soon.

Wow. What a reason never to sign a POA if you think your co-ownership will be co-opted. Seems like deja vu.

I do agree about changing the topic title.

It's really a damn shame, not just for you as the owner of the dog, but for all breeders. How many owners of fine dogs have chosen not to let the dog stand at stud here after hearing horror stories such as this? What a nightmare.

Mary Gattone is a real character. What do you expect from a person who breeds AMERICAN shepherd lines? SHE know all the ins and outs from being an AKC judge!
I will MAKE SURE that I inform EVERYONE that I Know.  What about people that  have put money out to use him as stud? MONEY GONE!!!!!! DUE TO MARY GATTONE!! AKC is a SH%* Organization here in America! MARY GATTONE IS  a SH&^ person and a DOG THIEF! Took advantage of a person who lives in another Country.
WHAT AN EMBARRASSMENT!

I hope that you get your dog back.  I think that you must make a trip to America in person with proof, and go to the police in person, bring his papers and show them. The AKC office too. But then again, who knows where or what she would do to the dog for spite!

Forgery is against the law.  People do jail time for this!

POAs are helpful documents when limited to the situation at hand.  The problems occur when someone who needs the other party to only perform a few limited tasks gives a general POA that is then abused.

Bottom line: ALWAYS consult an attorney before giving anyone a POA of any sort.   The relatively small amount of money we charge to draft or review documents is worthwhile insurance against far bigger problems.
