I think that's just because he's in movement in that earlier photo, CMills.
Large 'soft' ears will often bounce around when the dog runs, especially
at that sort of age.   Cartilege is not strong enough to keep them upright,
but because they are floppy they temporarily elevate, then fall down again,
as the pup runs around.

Testicles are usually covered in a contract. Breeders will usually replace the puppy or refund part of the purchase price due to the need for a spendy neuter if one of them is missing. This surgery can cost as little as a spay if they can readily feel it, but can cost significantly more if they have to ultrasound it and dig around to find it.

My youngest was chryptorchid and I had just the missing one removed when he was two years old. Due to my personal preference, I chose to leave the other one intact even though he will never be bred. I must say that the first thing I did when I saw him post-op was to lift his leg to make sure it was still there. I'm not that attached to the remaining one either so if he has prostate problems later in life, I will have it removed then.

Testicle status should have been disclosed at time of transfer. It should IMo have been noted on any guarantee as well.

Thanks all. The words "pet quality" never came up until I mentioned the issues he was having.  I realize at this point the mistakes that I made in not getting a written contract, but I'll guess I have to chalk it up as a learning experience.

We all make mistakes in the beginning. By learning from them I finally have the amazing dogs I have now. You'll figure it out :)

My youngst was chryptorchid, but I knew it when I got him and there was a reduced price for him. I couldn't be happier with him!
