She put Camry back up for sale after agreeing to refund me. As of now we have reached an agreement and I am hoping Peggy will follow through and I will receive my refund. We had a barn/garage fire last Sunday that killed our pigs. I am hoping to use that money to replace them and will put off buying another female for a while. Thanks again.

You had better search her name out on this site and see what comes up. Then you will see why I said. get it in writing with dates.

If you can't get the breeder to commit this latest agreement to you in an email, at the very LEAST you should send one to HER that spells out what you and she have just agreed upon and requesting that she reply via email if the terms you've described are not correct as she understood them to be.  Something along the lines of:

"Good day, Breeder X.  Per our telephone conversation today, Oct. 29 2011 at approximately 7:00 PM EST, you have agreed to refund all monies you received from me for the purchase of Dog Y, as well as the monies I provided for shipping costs and any other incidental expenses.  You committed to sending me $dollars immediately, with the remaining $dollars and cents to be received by me from you no later than Nov. 5 2011.  In refunding to me the total amount of money I paid to you, the original agreement between you and I for the purchase and shipping of Dog Y is cancelled.

Unless an email from you that disputes any part of the above statements is received by me no later than Oct. 31 201, it will be understood that you are in complete agreement with the above terms and will fulfill your end of the arrangements as described."

That way, at least you've got SOMETHING that can serve as a contract of sorts...in case you end up having to go to small claims court.  Good luck.

i am with most of the responses, What you do with your dogs is your own business. This was a business transaction that went sour and you should do whatever you can to make her pay. Sue her for the dog because if she is selling it for more than you bought it she either is trying to make up for the lost money or the dog  has turned out better than she expected and wants more now.
Most breeders are doing it for financial gain otherwise they would not be breeders. So whatever your intentions are has nothing to do with being scammed  whether you can afford it or not

Since you care about the breed as much as you do, it should be refreshing that people question your motivations.

I hope you get your money back (as said previously).

Either way, you owe NO ONE any sort of explanation about how/what/why you are doing what you are doing (even those who question what you are doing like I have).

She was supposed to refund the shipping by 7:00 last night. Instead she feels she needs a day to think it over because of the thread I posted here. I am done dealing with her personally and I am filing Paypal claims today and will be in contact with the Michigan State Police and her county court house on Monday. I intend to file in small claims court and will pursue her for the cost of the dog, shipping, as well as the court costs. It's a 12 hour ride for me but well worth it.

I have given her an entire week to refund or set up refund terms. She has twice cancelled flights on me and now missed her own deadline for the shipping refund. I cannot believe how unprofessional she is acting. She acts as though this is a case of buyers remorse when in fact on two separate occassions I was ready and about to travel to pick Camry up from the airport. The agreement of refund came directly from her when she missed the second flight.

This is a very unfortunate situation and as was recommended in this thread I will no longer purchase any dog that I can't personally drive to pick up and pay in person.

Thank you for the advice and all of the messages from members explaining their own struggles with her.

Just an update. She had the Paypal disputes closed because they don't handle live animal transaction. Fortunately I paid through a bank account(two actually) and can file a fraud charge with my bank and they will force Paypal to refund the money per the woman at Paypal's dispute dept.

I still intend to contact the state police as well. I am going to file theft charges and take the report to my bank to have the transactions reversed. She thinks she's managed to screw me over but now instead of ending it peacefully I will do what ever I can to make sure every one knows what she did and what kind of person she is.

"She had the Paypal disputes closed because they don't handle live animal transaction."

I would say that this is a pretty good indication that she has no intention whatsoever to return your money.

Oh I agree but my bank can force her hand. I also intend to files theft charges against her with the state police. I'm more than willing to drive out there to file the charges. If I hit a wall with the bank which I don't think I will I will then file in small claims court. I've got many options ans she would be far better off to refund me than to continue this mess but the choice is hers.

She emailed me earlier asking "why I won't just take the dog I purchased." Hmmm maybe the two days wasted waiting for a dog to arrive to find out that both times she didn't even attempt to ship her. Not to mention she said she would refund and I expect her to live up to her word. Her financial difficulties are no concern to me at this point.

If she was willing to refund your shipping charges and give you the dog, are you willing to pick her up since you now seem willing to make the trip?  Just asking.
