i brought a 1200 dog from a breeder so i could breed with him and his balls havent dropped yet if they don't drop can i sue the breeder as i put that in the application for that i wanted him to breed with my sister in laws dog

Did you recieve a contract from the breeder indicating that the dog will be used for breeding, and guarantee on descended testicles by a certain day? If you recieved none then you're out of luck as far as legal process goes. It's not a good idea to sue anyone without coming to court with a contract in your hand.

You need to remember that these are living things not cookie cutter productions. With all living things you may run into problems like this. I'm sure the breeder never intended for this to happen. So my question to you is; Did you contact the breeder and inform them of the issue. As well as ask them to make things right? If not I would at least do this before you started wanting to take them to court.

You need to have your dog fixed soon. This could cause him to have cancer and to loose his hair. Sorry for your bad luck. Take care of the dog first.

Oh yeah next time you want a pup that has balls don't buy a puppy before nine weeks old. Their balls should drop by then, if they don't have them at nine weeks old wait to buy them until they do or find another pup.

Jlb82 - If a dog is going to get testicular cancer its going to be over 8 years old, not a baby. There are plenty of cancers to get,even if  you remove the testicle,  the dog can still get penis cancer, or prostate cancer, or colon cancer etc..  
Some breeders have had experiance with this, and include it in there Guarantee.
It keeps your dog from being shown. A dog with a retained testical STILL can be bred, but it shouldnt as it is possible that some of the offspring will also have the defect. It is not life threatinging. 

If this is a pet , consider the removal the same price as a spay in a female dog. A part of responcible pet ownership. Get your puppy on pet health insurance, as it usualy covers part of surgery.

Yes a dog can get cancers all over the place for all sorts of reasons. Especially if the dog has has testicles that never drop. SOME dogs can still be bred, but if the testicles were to far in and kept at even a one degree temperature higher than normal it will probably become sterilized. Usually the ones that can be bred, which is still not recommended as you said, the testicles will drop once in a while and than go back in. The dog should be neutered most definitely.

There is no rush to have the puppy desexed !!!!!

For me I would certainly give the puppy even upto 18 months before rushing him for the chop.

As a veterinary nurse of over 18 years I have only seen a very small number of dogs that have cancer due to a retained testicle.

Many other cancers can get them first~~~~~~~~
