this weekend we entered a dog show and won our class. first time in any show ,  but the question is they(newspaper) took pics of my dog with out talking to me and now newspaper has them for sale. do they have the right to SELL pics of my dog with out asking?????

Wow, I don't know anything about that legally, but that SUCKS. Have you contacted the paper?

Photographer owns the pictures, no matter if it's you and/or your dog in the pics - photographer owns them.  If photographer works for the newspaper, newspaper owns the pictures.  They can sell the pictures, post the pictures, put the pictures in an article or broadcast the pictures all over the internet - copyrighted by the photographer.  The only way they may not have free reign to sell or publish pictures is if they are pictures of small children - then they may (or maybe not) need permission from the parents - but the pictures are still owned by the photographer.

There have been newspaper articles written about me in the past - dog training and dog rescue that I do - and I've had to buy the pictures of myself/my property/my dogs if I wanted them for myself.

I dont mind if they were to publish the pic .but to put pics of my dog who I am the handler,owner,trainer&breeder of is wrong.It may be lawful  but it not right for them to sell pics of my dog with out asking or even telling me. Leaving me to find pic of her on internet.

Eichenluft is right!  This happened to some folks in my town who were at a parade together kissing- unbeknownst to either of their spouses!  They tried to sue over the publishing of the photos in the local newspaper due to the breakup of both of their marriages.  The law ruled against them because it stated once they decided to participate in and/or be present at a public event, they gave up their right to privacy.  Unless they portray your dog in a negative fashion, I would ask the photographer to give credit to you and your dog.

I don't see the problem?  The shows are public.  I am a show photographer for 24kPhoto (did NASS, WDA Regional last month, and a club show yesterday) and we take pictures of every single dog, then sell them on the web site.  Some people want additional posed pictures, so we do whatever people want in addition to a stacked and gaiting photo, and also publish those on the site under special requests so people can buy their photoshoot.

In some situations a model release is required (like for stock photography) but generally if you are in a public place, people can take pictures of you and do whatever they want because they took the photo, not you.

The nice thing to do is for the publication to offer you a free copy of the article/photo, but there's really nothing illegal or even unethical unless your privacy was invaded or the picture is somehow misleading.

I belong to a schutzhund club and when we put on a trial and the person enters - the entry form has that we can use any photo's taken if we so choose....

Eichenluft is correct, I am a professional photographer, the photographer or newspaper owns the pictures...it is a public event...anyone  can take photos and sell them. Newspapers usually do give credit under the photo, unless they were unable to find you. Be happy that you have a photo of you and your dog to purchase...
