My boyfriend and I finally got our opportunity to meet with Wayne Curry regarding the death of our puppy. We met today in small claims court and have reached an agreement that I hope he is as satisfied with that agreement as we are. We have a brand new sable female from Kraftwerk and couldn't be more pleased with her. Mr. Curry explained to us that staffing issues that have since been rectified kept him out of the loop. Had he been appraised of our troubles, we might have been able to take care of this sooner and more amicably. I can honestly say that I have a newer, more positive perspective on the man and the company. I think that the strong emotions involving this matter clouded things some and prohibited both parties from moving on. Our comments about Kraftwerk K9 Inc. and Wayne Curry posted on previous threads should be disregarded. We are completely content with this turn of events and our resolution of this dispute. She will be examined by my veterinary staff tomorrow to be given a clean bill of health. Wish us luck in puppy potty training adventures!

I'm very glad that you DID follow through with the court proceedings - maybe Mr. Curry will think twice before disregarding any serious complaints about his dogs or his business practices in the future if more people would do more than complain and actually do something about it.  Good for you.  Have fun with your new puppy!

Sorry, but I would not buy anything from someone if you had to take them to court.

When someone sits in a court of law with a judge sitting in front of him with the authoruty and power to render a binding decision.    Person's tend to cast a whole different light on the matter.

 

If you have a dispute with a breeder it is much better to pursue a legal solution to the problem than coming on here and blasting that person from stem to stern and then saying disregard what has been said in the past.

The very real threat of legal action solved your problem not the verbal assualt that was mounted here which amounted to a hill of beans.

Sorry, but I have to go with matthews on this one!!!  I DO wish you luck with your new puppy and all...but for the life of me, I can't understand why you would take yet another puppy from someone who did you wrong in the first place. 

Just makes me wonder if this whole "he's not such a bad person" speach was not part of the legal proceedings!!!

Happy for you and your new puppy.

But for the large number of us unable or unwilling to pursue an out-of-state court case, matthews is right.  We'd never do business with Wayne Curry again.   After 2 1/2 years of caring for a chronicly sick dog with no hope of improvement, I have nothing good to say, so will say nothing.

Folks, this proves that pursuing legal action has far more of an effect than merely posting the preliminary accusations on this database. In the end, Wayne Curry honoured the agreement and provided this woman with a puppy that is hopefully healthy and will furnish a lifetime (of the puppy/dog) of excellent companionship and/or utility.

Vettechgirl and her boyfriend did the right thing-they took their complaint to court. I realise that is not an easy option for everyone as some live across state lines, etc.. Why would someone take a puppy from the breeder who provided them with a faulty puppy? In these circumstances I think it is an appropriate settelment if the plaintiffs received what they truely wanted.

This debacle began as a sad story and through perserverence of the plaintiffs has a happy ending. I agree it is a shame that it had to progress to a court case, but even though we are all supposed to be adults in this dog world some of us (occassionally) shirk our responsibility. I do not know to what degree  Mr. Curry and/or the members of his staff share the blame for the necessity of a legal endeavour, and at the moment it is not important.

I am not a fan of Wayne, his kennel, his practices, etc. but that is immaterial as I do not own one (1) of his dogs and do not plan to make a purchase from him. So, I will let the chips lie on the floor and say congratulations to Vettechgirl and her boyfriend for following through to a solution.

Vettechgirl...Congratulations and a HUGE pat on the back for your perserverence...It is a daunting task, putting your time in on seeking restitution...It is a time consuming nightmare ;   the scammers know this and so they continue until someone stops them.

Bob-O  I agree with your statement above completely...
that is why I posted my previous detailed contact info on the hustler thread.  Anyone who is still hoping to pursue legal action on the scammer alert  I  previously posted about, which was later removed, please contact me by private email and I will provide it to you so you may proceed with legal actions on your own cases...
that is the only way to get your restitution for the problem when the seller turns a deaf ear on you once you voice your complaint to them.    That is why the postings were done by me in the beginning.
