That is another part of the injunction get it done right now....into the court before the dog disappears. Charge her with anything you can think of...
vom Fenwald would I like to get my hands on her.. I'm so sorry this has happened at Thanksgiving time.
If you hit her her hard and fast maybe she will buckle and give her back...
This reputation in Texas will get her NOWHERE...we are a tight network here.

If there is a contract, whether written or verbal that is what makes it a civil matter. Make certain that if and when you go to a judge have all your paperwork in order and make sure that everthing matches. The judge will base his decision on your proof not hearsay; judges like paper trails. I know that I asked this question, so I'll ask again. In what state and what county was Greta taken from? From all the information so far that I have read, the only part of this incident that is criminal is the assault. Unless Karama has left out some important details.

Your right Debbie, if he called him a name and hit or shoved him, or touched him , in anger , period it also becomes , not welcome and not invited,...Criminal tresspassing..She came there with the intent to do harm, bodily or verbal and /or both.
Then she took , unlawfully, without a writ from any Judge, any decree, something off that property.
Several laws broken , not just one. More than one, puts this into a different catagory...No longer a misdemeanor....

RE. In what state and what county was Greta taken from? Fenwald is in Caldwell Cnty, but Karama is about 30 miles from her so not sure if she too is in same county.

Okay Karama, I did a little bit of leg work for you. I do not know all of the details so that will need to be taken into consideration but this is the jest of what I was told. When Fenwald come onto your property without your permision and assaulted your husband and took Greta, unless she had a order signed by a judge (not just a contract signed by both of you) she has committed Robbery (the assault will depend on the age of your husband and what type of assault it was). The matter of the dog is indeed a civil matter, however if charges have not been filed by your local police dept. what you will do is go to your District Attorney and file robbery charges. Yes this means you will go over the police department and do it yourself. Then an arrest warrant will be issued for Fenwalds arrest. Since the dog was stolen property Greta will be returned to you as per the judges order but then you will still have to go to court to settle the civil matter regarding Greta. Each one of you will have to prove that there was a breech of contract in what ever aggreement was between you and Fenwald. In no way must you go to her residence and try to get your dog back or you will find yourself in the same mess she is in. The assault is the only criminal thing that has been done in this matter. We are attempting to upgrade charges to robbery since the clear intent of the defendant was to take our dog by any means possible. Have filed civil suit in Caldwell County Texas for the return of Greta. The defendant should have been served today. She has ten days to respond then a court date can be set. We are looking at Dec 23. I have all paper work, cancelled checks, vet expenses, micro chip information, letters from neighbors who have seen Greta here for over six months. Anything else I need? Also I do have a copy of her web page congratulating my husband and I on the purchase of Greta! Also have a ransom note requesting almost $4,000 for the return of my dog.

WHY HAVE NOT ROBBERY CHARGES BEEN FILED...YOU NEED A WRIT TO GET IT ON FASTER...DA CAN HELP YOU ..GO INTO HIS OFFICE AND ASK FOR THE FILING NOW...HIS CLERK DOES IT.
THIS WAS A ROBBERY . A THEFT OF PROPERTY WITHOUT A COURT ORDER FROM A COURT..POLICE DEPT MUST HAVE DEAD BRAINS...GO TO THE DA'S OFFICE AND TELL THEM YOU WANT ROBBERY BY ASSAULT FILED...SEPERATE CHARGE...TELL DA YOU WANT AS MANY CHARGES ON THIS SCUMBAG HE OR SHE CAN FILE...YOU TELL THEM ..YOU ARE THE PROPERTY OWNER AND THE OWNER OF THE DOG. TAKE PAPERWORK AND MAY SURE YOU HAVE A POLICE REPORT....UPDATE THE POLICE REPORT IF NEED BE.

I o so appreciate all the help. I have never been involved in anything like this before. Will go to the New Braunfels PD today get a copy of the original police report. Then off to the county DA office to make noise. Seems if you push enough things may get done. Will keep information posted.
