is i possible that when to file in small claims court you specify you are seeking the return of the dog only and that you will refund any money that has previously been given to you?  logically it would seem if dogs are legally considered property you could follow the same guideline as if you were repossessing a car or any other item due to lack of payment, but you'd have to ask a lawyer in your state.  so perhaps your best bet might be contacting a lawyer, or if there is a law school near you contact them for advise.  often law students will be available pro bono, but a fully licensed lawyer might know 'the ins and outs' of the system a bit better than a student.  it does seem most judges will allow the dog to stay where it is but if you can prove breech of contract, false representation, or animal cruelty or endangerment you might sway the judge to act differently; this is where a lawyer can really help out.

another possibility:  find out why she wants to keep the dog then find out what she wants even more than the dog and try negotiate a deal/ a swap. good luck and i hope you get her back asap.

A few of you are directing an individual to conduct themselves in an illegal manor.... That will not save the dog it will put the poster in jail. So I suggest the poster to go down to the local SPCA with a written statement of all events at hand. They would complete a full investigation and if what the poster suggests is truthful.. ALL DOGS WOULD BE REMOVED! Done deal and her dog would be handed back to her.. Conduct yourself LEGALLY NOT ILLEGALLY you would be no better than the individual that stole the dog JMPO

Candis,
Some people have no respect for the law, they use it, they know its fubar.
They do respect someone in their face.    They also leave there homes every so often.
I've had my fill of the system, the law, the special interests and politics, lawyers, doctors and indian chiefs.
No matter what the advice, the poster is responcible for their own actions.
Natural selection.    Stupid is just as bad as weak nerve, bad genes, no sense or depending on others to settle their problems.
I know what I would do, but then again I am confident in my abilities.
To each his own.
Moons.

GO TO THE MEDIA. How do you know this woman isn't harboring other stolen dogs? She has yours. Expose her for the scumbag she is. Is it even legal to have that many dogs in your area? You know what they say about the squeaky wheel. Ask her if she really wants to have a camera crew from the local TV station knocking at her front door.

Triogirl...

Funny, my husband thought about contacting the media.  She stole a pom pup out of the peoples back yard on saturday night.  She was caught with the dog and the people are prosecuting.  I am sure there are others stolen as well... if there are two?

I must admit triodegirl if you can get the local tv station to do it (some love this kind of crap) you might get some suport.
You may not however get your dog.
People like this have ways.
