I remember this litter..

Post the x-rays, both the pre-lim AND the finals..  and if the dog was sedated or awake for each session.

Yeah, sorry, but I can't feel too sorry or outraged for you. You went ahead with the purchase before you had confirmation of the dog's hip & elbow status--you gambled, and you lost. Given that you apparently don't bother to do more than OFA prelims before you breed your own animals, it suggests you're more interested in getting puppies on the ground than in waiting to confirm hip & elbow soundness, let alone any other breed worthiness points of consideration, and I'm sure the cachet of getting your hands on an 'imported stud' made you giddy with anticipation of your next litter [note: he's only a 'stud dog' after he's been used for breeding and produced a live litter at least once--prior to that, he's just an intact male dog]. That $3000 price seemed like a real 'deal' that needed to be jumped on lest someone else swoop in and buy him out from under you, hmm? Did you stop and consider why someone would import a young dog like this, and then decide to sell him j-u-s-t before he was old enough to OFA certify? Didn't you wonder as to WHY this dog was REALLY available? My sole interest and concern in this messy business is the dog himself--what happens to him? He's certainly of no worth to you, unless you decide to breed a dog that's been officially rated as dysplastic, but he's done nothing wrong, and he's a young dog who deserves to be cherished by someone who doesn't give a rat's ass that he isn't going to generate any income. Let's say you and Michelle Riner come to some sort of agreement regarding the dog's purchase price and the cost of the x-rays--what happens to Kino aus Mecklenburg, now that he's a 'washout' for breeding purposes? At least when someone raises REAL livestock, the animals affected by a breeder's poor choice become food for someone.

I am glad to hear you are doing something about this. People not being true to their word or contracts they sign, is just not okay. There are way too many and it gets very tiring. I hope Kino will be done right by in all this; there is a being in that body that deserves a rich, full life.

I would have liked to have seen the prelim xray as well..  and also need to know if the dog was sedated or awake for each.

However, what is on the final x-ray you attached is clear. Right hip is lax, and is why all the degeneration already, at age 2. The hips aren't stellar, but in no way should he be crippled, and probably won't show signs of problems until older, as long as he is maintained and kept well.

The agreement is pretty clear, she will refund your purchase price on the dog BUT.. you must RETURN him to her. I don't really think she was trying to "scam" you, or she would not have written up the agreement so concisely.. 

As Hexe says, the issue is really what now to do about the poor dog.

Personally, I would have expected this from that pedigree, there are FIVE fast-normal ancestors in the 3rd generation...  and the DAM is fast normal....

 

ANYTIME you buy a dog with NO xrays, ALWAYS have them done BEFORE paying out huge sums of cash. ALWAYS deal DIRECTLY with the vet clinic doing the xrays IF you are the one PAYING for the procedure!! That way, YOU and only you will be the first one to get the results..  and can do with the info what you choose...  ALWAYS get a clear copy of the xrays... 

Honestly, for all the money you spent on OFA, you would have been better off having a PENNHIP done, and that at least would tell you what you need to know about the animal's potential...  Those results are back usually in a day.

I am not sure what you can do at this point..  3K is a heck of a lot of money for a pet, import or not..  see what she will do, maybe the two of you can work out some amicable arrangement about placing him as a companion.

If not, you are headed off to court.. 

Several of this litter was imported as pups.. there are others in your area that have the lines, if you really like them that much. From what I saw, none of the others have ratings yet either..  maybe one in germany did pass. 

 

Since seller is probably reading this, (or will soon)  what exactly do you want to do?? 

Are you able to return the dog to her?

Being it is holiday season, what if she spent all your money already? How long would you wait to get refunded?

How much is a "fair" price for a nice longcoat pretty showline companion?

If this had happened to you, what would you do? (Especially if distance is a problem)

 

Bad situation... I sincerely hope the outcome is better.

So sorry that this dogs xrays show signs of HD; however, well taken care of and a controlled exercise environment; meaning light duty exercise but continuous; swimming, soft running on the sand on lead, walking on sand or soft grounds like a l/4 mile tract on dirt what you find at a school etc could be advantageous to this dog, however, not for breeding. Keep very muscled and lean... Best of luck, in the end it is always the dog that pays the dues. Nan
