Court Case for Murdock vom Bubenlachring registered under Kennel Club of India
Dear Dog Lovers / Hobbyists / Show Judges,
I am Suvadeep Das Gupta (marked as FP in the Court Case documents) from Kolkata city of West Bengal. I have a friend namely Vinod Kumar Mishra (marked as OP in the Court Case documents) and he is also living in Kolkata. He had requested me to visit various German Shepherd kennels in Germany because he wanted to purchase and import a German Shepherd Dog. Based on his request, I entered Germany through Munich airport on 26th February 2010. Before going to Germany, he had given me names, addresses and contact numbers of various German Shepherd kennels. I did photo shoot of all those dogs and returned back to Kolkata. By seeing those photographs, Vinod Kumar Mishra decided to purchase Murdock vom Bubenlachring from Oxsalis kennel. Before going to Germany and importing Murdock into Kolkata, I had conveyed to Vinod Kumar Mishra that he must take proper care of the dog. In return, he assured me that he would take proper care of the dog and would fulfill every requirement of the dog. Ultimately, Murdock arrived Kolkata in the night of 25th May 2010 by Lufthansa airline.
Thereafter, I started realizing that Vinod Kumar Mishra had bluffed me completely. Earlier I had an impression on him that, he is an animal lover. But, gradually I started understanding that he has no love / sympathy for the innocent dog and he brought the dog through my help for commercial reasons only. Due to his negligence, lack of care, inadequate and cheap quality of feeding, inappropriate way of keeping, unavailability of temperature controlled room, the health of the dog gradually started to curtail and the dog started to suffer from various diseases. Repeatedly, I advised Vinod Kumar Mishra that proper care of the dog must be taken in order to stop the sufferings of Murdock. But, Vinod Kumar Mishra was reluctant towards well being of the dog because Murdock was not producing litters (due to weakness arising from improper care and unavailability of temperature controlled accommodation) and he wasn’t able to earn money through Murdock. When situation turned from bad to worse, I told him very strongly that I would complain the matter to competent authorities for proper rehabilitation of the dog. Then he threatened me by saying that he would not return my money that was spent for travelling to Germany and purchasing Murdock. Due to this reason, I couldn’t inform appropriate authorities regarding suffering of Murdock. After various hassles, hurdles and tussles, I have managed to recover my money recently; therefore, I am bringing the truth into the notice of every appropriate authority and dog lovers / hobbyists / clubs / show judges of India regarding the suffering of Murdock. As a strong protest against the cruel acts on an innocent dog, I have already filed Case No. 3592 dated 25.08.2014 to the Court of the Executive Magistrate at Barasat, North 24 Parganas, West Bengal, India and the case is under trial. Since Vinod Kumar Mishra registered Murdock and his Gangoi Kennel under Kennel Club of India, therefore I have also informed Kennel Club of India regarding inhuman acts of Vinod, so that possible measures are initiated and sufferings of Murdock are restricted.

Pray tell, is the poor dog still alive? And is he still in the hands of that individual? I do understand that you needed to recoup your money, but would the same court you have filed the charges of neglect not have also given you recourse to get your money back when he threatened you? I am glad you have reported this man to the authorities now, but sad the dog had to endure such neglect because you wanted your payment before reporting the owner for not properly caring for the dog.

No idea how the law works in India, but even in UK, suing someone for your money in their hands does not always mean you will get it back when you win your case and I would imagine the costs involved could be quite considerable.

I had recovered my money partially before proceeding to court. Thereafter, I had filed a case at the court against the person because he is still retaining the dog. I made an appeal through various forums for rescue and rehabilitation of the dog.
