Now let me see if I can explain this and if anyone out there that knows genetics please help and tell me just why/how this would happen or has seen it before. I do have a pic.
1. Puppies background is grandfather:Arak Frankengold on sire's side, Dam's side, the pup's great grandfather was Ursus Von Batu & Oma Remus...also, mother had 4 pups this liter, 1 stillborn, 1 died at 2wks. born was 2 females 2 males. Lived 1/1. And the male was "very" small. But, appeared normal otherwise and happy pup. Bitches previous liter was to same sire and had 4 healthy pups.
2. Description of deformity: the left ear was backwards, internal ear intact. when i say backwards, and some missing; is where the flap at 6wks on a pup's ear should be would be on the outside his was on the inside (by his skull) and where the little split in the ear..normal, i say split, but not actually; it was on the outside or lateral part of his head. and was missing a piece of the ear, this ear was in 2 pieces, slit down the middle. You could tell it was not a injury. It didn't appear to affect his balance nor gate. Didn't appear to affect his hearing, although when laying and watching he would put good ear up to kennel and clock you with his eyes.
The Kennel owner said I could exchange him for another pup, which he had a set of almost 3wk old imported while the mother was pregnant. +200.00 to the fee from the difference of the other pup @ 800.00. Now, my problem is; is he really breeding properly? I cannot get my 150.00 down back, I ate that, or one of his dog's did. Do I trust a breeder that sends me a pic at 3wks, most likely knowing and can really tell there's something wrong with the pup and not tell me he had a deformity knowing I lived so far away. He told me when I got there that he noticed this deformity 4 days prior to my arrival, knew my email address (so he should've emailed me with this problem)...was going to actually sell me this dog at 800.00 + 25.00 for chip.
Other dogs, kept in kennels, on concrete, fresh water..did't see food out, but *my* pup acted hungry, bitches with whelping boxes where kept in an A/C'd house, and very attentive to thier liters, althought the mothers REALLY looked drug down, not like pics you will see on this site. I would put it "under-nourished". The 3wk old pups didn't act like 3 wks old pups, eyes open, just whimpering and knudging around to find a teet. Not playing like a 3wk old pup would do.
Not meaning to complain; just what happened with this puppies ear????? Has anyone EVER seen anything like this. I would claim it a genetic deformity but I'm not a genetist.

You are making a hopefully 10-12 year commitment with this animal you buy; 800.00is a back yard breeder price. That was your first clue. You do not want to get a puppy with a birth defect as you will not be able to tell what else might be wrong with him until you get a vet checkup and that may not even show anything right now.
The GSD is the MOST popular breed in the world; I am sure without question you can find your self another HEALTHY; well bred puppy.
Keep in touch on this forum and something else NICE will come up for you to buy. Just keep looking and put the word out what you are looking for and whom you want in your pedigree. And do you want only a puppy or would you consider a RESCUE; someone you can save and give a good life to? Rescue organizations also do get puppies in occassionally; not as often as adults and young adults or even older puppies. Just some food for thought. best of luck in your search, Nan

As for this defect...weird!
Like others said...cut your loss and thank the powers above it is now rather than later.
There is an issue with your deposit: I am sure you put a down-payment on a puppy from THAT litter and no other and that the down-payment was obviously for a healthy, normal puppy and NOT one with a genetic defect.
I can also add this; when you are happy to pay 800 add your transport costs and add your loss, you may have well gone to a reputable breeder who I am sure would not put you through this drama...right from the get go.

Why did you not receive more recent pictures?
An abnormality can occur anywhere in nature, it's not necessarily genetics.
The breeder would have offered you another pup at the same price if he were reputable, or given your money back considering the fault.
Has nothing to do with the price of a pup.
Doesn't sound like an amateur BYB, sounds more like a puppy mill to me.
If the breeder won't give you satisfaction, then name names and start a brand new drama.

As for the can you trust??? and all that......I dont know it can be simple or complecated dealing with humans... I like to say try and communicate with that persona... and in the end.. Remember you are an adult and must eat what taste good to you.

Sounds like the kind of breeder I loath: wouldn't cull if there is a chance he can get a buck off the pup; never mind the issues for the pup or the owner.
Look elsewhere, I'm sure you will find a good breeder who will be honest with you. I'm so sorry for your experience!

Defects happen but to know damn well you were traveling to pick up this dog and not tell you is a complete d*** move. I would tell the guy I'd plaster his name and the story all over the internet unless he gives your money back, and maybe you'll get it. You should've taken pics of the pup.

My breeder has always gone out of his way to send me pictures every week, get regular vet checks, check for abnormalities in growth and overall development daily, check for both testicles in males, etc... In my opinion, those are just a few of the things that a reputable breeder would do. If your breeder cared about the puppies he was producing, he would have noticed that almost immediately :-( It just sounds shady, that he just noticed it 4 days before you went to pick him up...I don't care how many puppies he has on the ground each one should be inspected daily!
Sorry to hear that you were ripped off. I think you should be compensated for your $150 and travelling expenses. Even if it was a non refundable deposit.

Deformities can and do happen in all living things, so casting any judgement "because" of that is wrong.
The idea of someone (breeder) not disclosing such things to prospective buyers....is another thing.
Communication is key.
