I propose to settle whereby Vollkommen Kennel:
1) refund in full the original sales price of Izzie, $1600 if my memory serves me well; 2) reimburses me for X-rays and OFA certification of Chica, $312; and 3) pays the cost of $262 to have Chica spayed next Wednesday, 9/2; and 4) removes the reference on your website that 1 of 50 pups may develop hip dysplasia.
This proposal will terminate by 5:00pm tomorrow, 8/26/15.

This is from the person who authored this post....he is an attorney for the IRS and seems to get some satisfaction from threatening and attempting to intimidate anyone who fails to bow to his demands.
I offered him replacement puppies from 3 different litters, who were according to him "not acceptable". He then wanted me to import and pay for a puppy plus shipping from Germany. He threatend to take me to court and force me to come to Dallas for the proceedings. Through all this I continued to offer to do the honorable thing and replace the puppy or give a partial monetary refund.
Finally we had a puppy that he agreed was
an "acceptable" replacement.
To preclude any possible legal aftermath my attorney drafted a contract, which he signed, in which he agreed that the replacement puppy was only guaranteed to be in good health and current on all worming and vaccinations at the time of delivery.
I am very sorry that Chica is dysplastic we do everything in our power to be sure that we produce puppies that are structurally correct, healthy, outgoing and social. For the most part we are successful. When there is a problem we make every effort to treat the client as we would want to be treated. Obviously that is not enough for a very few.
He has vowed to to take his battle to social media and said that he is "just getting started"
An honorable man would abide by the contract that he agreed to and signed.
Well, good luck to him, then, because all he's going to accomplish is to dilute the sympathy sensible people would otherwise feel for him in having had a run of bad luck. As far as I'm concerned, you, the breeder, did more than right by them by providing a replacement pup for the first one, as I wouldn't have expected or asked for that from the breeder I purchased my dogs from...and it's also not something that the McCutcheon will get if he imports a pup from overseas, either, except in very rare cases.
In short, Vom Vollkommen Kennel went above and beyond for their client when the pup they initially purchased went on to develop hip dysplasia as she matured, and there are many breeders who do not stand behind the pups they produce to that extent. I can find no fault in that.
I think Hexe you are one of them who don't stand behind your pups and your breedings,if you support these practices.There is many breeders out there who stand behind their puppies.those breeders breed with passion and as hobby,they don't treat breeding as a way of making living or as a business.When you have more litter than 10 a year than sooner or later you will have problems,thinks just will start getting out of your hands.I think the buyer gave a chance to the breeder twice,both puppies had HD,would you try to get third pup from the same breeder because I would not.I think the breeder should give refund to the buyer and close the case,at least I would do it this way.
I think old shatterhand doesn't know what he's talking about. Hexe isn't even a breeder! Hexe is, simply put, a very health-savvy, GSD-savvy woman with a ton of experience and common sense.
Jenne,you also belong to the crop club,and trying protect what is not right.I don't care if Hexe is a breeder or not.she think the breeder did everything right and I think he did not,if you desagree that's fine with me.i don't care if he is a small,or big breeder with 50 years experience so is Hexe if he did something wrong ,should apologize to those people give them refound and move on.Same like you buy a lemon car or anything else,when the car start breaking down few months after you bought it.What you do than,you go back to the dealer to fix it,and after that if the same problem keeps coming back, you go back to the dealer and finally say I don't want this car.The same is breeding dogs.this can happened to anyone,but if this happened you should take care of this,and not let it go so far and let everyone know.I tell you why,you might be friend with the breeder,and I don't know them,but reading something like this I would never buy a dog from them nor recommended to anyone,and in the long run may hurt them.Now you can write whatever you want I express how i feel about this,and you can too.
Yeah, that's it. I belong to whatever you said I belong to...it can't be that I just spoke up and corrected your asinine statements about Hexe. I haven't even read this whole charade and in fact, I don't need to in order to state what I stated about Hexe.

old shatterhand, for the record, when I DID breed dogs [over 30 years ago now, and it was Siberian Huskies, not GSDs], I stood behind my pups to the point wherein if, at ANY time, the buyer was unhappy with the dog and wanted to return it, I would refund them their purchase price. Period. My rule of thumb was never to sell a pup for a higher price than I would be able to lay my hands on within a day if I needed to take one back.
I still think it's unfortunate that this ended up on the net. No matter who says what there will always be people who blame one or the other and spread the story. Years ago I had to replace on a severely dysplastic 7 month old out of 3 generations of OFA dogs. That was in 1974 when when hardly anyone xrayed hips in that specific breed. Although I refunded the money; it ended up with some saying that no one should ever buy dog from me as I bred dysplastic dogs. It's just not a win-win situation for any of the involved parties.
Blitzen, I agree wholeheartedly. I don't believe either party did anything wrong, save for the OP deciding he needed to smear the breeder's name on the web as some sort of punishment for something she had no control over and had done all of the appropriate screening to try and avoid such an outcome.
