I laughed and said if your so sh2222tty a person to divide them up I'll take em both! so at closing I got a house and two dogs! If you are financially able and suffecient time to care for them then keep em!

California is a community property state.

I had two dogs and intended to keep both.  There was no contest over the female because she had just gotten a mild displastic rating from OFA.  But, he challenged me for Shadow, who was 5 years old.  He said that he would take Shadow for $5,000.00!!!!!!  Yes, that is five thousand.  Then, he would sell him to a police dog breeder/trainer.  My husband was the supervisor of the K9 unit for the sheriff's department he worked for.  I called the trainer, and he hemmed and hawed and said, well, I like Shadow a lot, but he's 5 years old I don't know if I would pay that much now.

Sooooooo, I had to agree.  extortion.

Here is my $5,000.00 dog that I paid $250.00 for at a back yard breeder in Cloverdale.

No reason you can't keep the dogs.  Just be ready to give something else up.     It's all about what is agreed to.  Mine were listed individually in the paperwork so there was no room for misunderstanding.

FInd something your husband really likes/wants and bargain with him on it!!!  Could be money, or cars, or anything, it depends on him.

I gave my ex the house, I kept the dogs, and haven't looked back.

I had similar troubles in my divorce back in 1996.  My wife, who never seemed to care for my dogs, all of a sudden took a "special interest" in my HIT female.  (My wife could not do obedience at ANY level so the dog was a waste in her hands.)  When we split assets, she made me place a high value on the female or give the bitch to her -- I paid the $$$.

I gave this woman the house (on a hill, tennis court, the works), all the free cash/investments, and more -- in order to "buy" the custody of my kid and all of the dogs but one (a HIT golden who my wife did really care for).  I walked away with about 40% of my money (she had none of her own) but with my loved ones.  I can't say I never looked back, but surely it was worth it.

This works pretty good for any asset that is wanted by both parties:

First person lists the asset.

Second person lists the value of the asset.

First person then gets to make first pick over taqking  that asset for the proce listed or giving the asset to the other party for the price listed.

It's the old "cut the piece of pie" routine for kids - first kid cuts the piec in two, and second kid gets the first pick of pieces.  :)
