Hi all! This happened just recently in PA. I dont know anything about it except that I was asked to crosspost this message. I am including contact information to the rescue/shelter that the puppies actually belong to if anyone has any questions. Anyone can PM with any info if you would rather and I will pass it on. I dont know any of the partied involved in this issue. Im just the messenger.

I just got off the phone with the lady who has the shelter. According to what she told me, the lady who was fostering the puppies had signed a contract with the shelter to abide by the shelters rules and guidelines to take care of the puppies. The shelter has these contracts to make sure that any of the puppies they rescue from pounds are found good homes and the new homes also sign contracts with the shelter to have the pups spayed and neutered when they are old enough to prevent those pups from reproducing.
The lady told me that the shelter can lose their license over this , according to the PA laws regarding shelters and how the dogs/pups are adopted out. There are rules and regulations about these things per PA law.
They contacted the foster home regarding setting up meet and greets with the pups and when they finally were able to get a hold of the foster home lady, that foster lady told them that she gave them all away. The shelter had several people waiting on these pups already.
This is a monetary loss for this shelter also since they had to spend money to pull these pups from a pound and they paid for the care of the pups at the foster home. Not to mention the money the shelter spent on vet care for the pups.
The shelter lady told me that they dont want to take the pups back and they dont want the money for them if they find them. They want the proper paperwork filled out to make sure the new owners get these pups fixed and to see that they are actually in dedent homes. The shelter lady sounds, to me, like she feels resonsible for those puppies and their welfare since she rescued them. Kind of how a breeder thinks about the pups they produce,IMO.
Right now they dont even know if this foster lady took money for the pups and just kept it. The shelter lady told me that , that is illegal and the fact is that the foster lady broke her contract with the shelter.
Now this is only one side of the story and if anyone knows the shelter/rescue/foster laws in PA please chime in here. I am going to do some checking on it also. I dont know if the PA laws change from county to county of if they are state wide.

The rules you mention here regarding PA shelters are similar to those in my state. Even rescues now must PROVE all pups are spayed or neutered or that they have a contract with the adopting family/person to see that this is done. There are also a swath of new regulations proposed for ALL BREEDERS coming down the pike as I write this with many serious restrictions, even for the person breeding one litter. But yes, many states have stringent regulations for shelters to follow, although many go unenforced.
As for fees spent, unless the woman foster collected a lot of money, or was given everything she needed to care for the pups, then I doubt the shelter is "out" any real amount of money and the trade-off, if the woman foster found decent homes, was less work for shelter employees. However, reading between the lines, this smells, like so many posts on here. Who knows what the real story is. At the very least, if the shelter is unhappy with the "contractual" breed alleged by the foster home, they simply won't do business with this individual again. In the meantime, hopefully the pups got decent and forever homes.

Hodie, I understand that alot of times these laws dont get enforced but Melanie is going to pursue this further. She is a rescue not a shelter. I did find the law regarding PA adoption of dogs concerning the spay/neuter. I will copy and paste it below.
459-902-A. Spaying or neutering as condition for release of certain animals
No dog or cat may be adopted by a new owner from a releasing agency unless the animal has been sterilized by a licensed doctor of veterinary medicine or unless the new owner signs an agreement to have the animal sterilized by or under the supervision of a licensed doctor of veterinary medicine and deposits funds with the releasing agency to ensure that the adopted animal will be sterilized. The amount of the deposit required shall be determined by each releasing agency. In no event shall the required deposit be less than $30 for a dog or $20 for a cat.
All Melanie wants to do is to make sure she follows the law so she wont be shut down, not sure if anyone will go after her for it or if anyone actually goes to see her records or not. She also feels responsible to make sure all those puppies get spayed or neutered.
I also hope that those pups all went to decent homes with new families that will spay and neuter them. Melanie told me that the whole spay/neuter agreement is a big part of doing rescue. The ones who run the rescues dont want to see the dogs/pups they adopt out make more that will have to be rescued.
As far as the money issue goes, the adoption money the rescue would have gotten from the pups would have gone to rescuing more pups/dogs and finding them decent homes.

someone probably offered her a couple hundred $$$$ for all 9 pups - for christmas presents? or for resale - who knows what the person(s) who "adopted" the puppies told her. I hope the puppies are each in great homes but chances are they were just resold. Very sad.

I would suggest you call Melanie directly about any other questions you may have. That way you will have the information directly from her and not thru another person.
