If you sell a pup or young dog and the new owners decide to breed her before two years old and then a year later have a xray done and the Vet tells them that he GUESSES that her hips will come back fair at best. Would you replace this bitch with a new pup. The contract says if hips cannot be OFA cert. at two years old will replace with another pup. This female is over three years old now and has had two litters and all pups were sold. The Xrays have not been sent to OFA. I want to do the right thing but I think this is a little much.

NO FLIPPEN WAY. It is common knowledge you check the hips before you breed a female.  He has breed her more than once, so it was no accidental  breeding. I would explain to him, he may have contrubited to the hip issues by breeding her to young and birthing can cause changes.

What was the agreement regarding breeding?  If the contract stated the dog could not be bred before 2, then no, they've already voided their end of the contract.

Not all vets are equal, in fact I would not accept the "diagnosis" of a vet unless it was a radiologist or someone who specializes in taking and reading the x-rays.  Or just have the OFAs done if that's what's in the contract.  But even if they came back bad I don't think they are owed a thing, depending on the agreement about breeding.

What does your contract with this person say about breeding before two years of age?
The dog is three years old and he has not OFA'd her, I believe the time for the contract was TWO YEARS OLD.

NO, because "fair" is passing, and besides the OFA has not graded them have they.

I would make sure to changes your written guarantee to close these loopholes......so it will not be an issue from now on...

No, I would not even consider it. And OFA Fair = certified free of HD, not a little bit dysplastic.

As far as I would be concerned, they bred their own replacement puppy several times over.

You have very little recourse if you are selling all your pups with full registration,
you have actually given full rights to someone to do as they may with their pup.
