I bred my bitch 2 years ago with a breeder and had a fantastic litter.
Wanted to repeat the breeding and paid for the stud fee (up front) in January 08 (last year). We did an A.I. in January 08, but it did not take. We went to repeat the breeding in August, however, the stud dog had prostitis and the vet recommened not to do the A.I.
I was trying to get a hold of the stud dogs owner for a follow up A.I. this January 09. He told me the stud had passed away. We did not have a written agreement, only a verbal contract (with witness). The stud dog owner does not have another stud for me to use.
I have made many attempts to contact. Had one reply that said "remind me what happened and we'll see if we can work something out". I replied to that email but no response. Been waiting weeks between emails and not getting replies to my phone calls.
Just want your opinions on what should happen from here.

I think you are out your money. It's happened to me as well. If it's not written in a contract, you are out of luck.

This has also happened to me once, the stud was only 7 years old and died suddenly.
I did not and would not have expected any recompense. That's Life.

What about the fact that I did not get a second chance at the breeding because the stud was sick....

Personally, I'm with Amysavesjacks...I think SOME form of payback should be given...if the stud owner doesn't have the money upfront, make payments.
I was in this same situation, only I was the stud owner. My boy (Goldens, mind you) needed to be neutered due to the fact that my father was going take him, so we had him fixed.
So, I had made a contract with a previous client that she could use him for a breeding when she was able, so she contacted me a few months ago, and I didn't have a stud for her, so I did the noble thing, and paid her the stud fee back in payments.
It's common courtesy to refund the money, I think.

It is a shame that people do not honor their agreements and even more shamefull that the majority of others say well shit happens. Keep persuing what you paid for and in the future get it on paper. does one buy the sperm or is one buying the pregnancy? If I am paing for a mating or a future litter of puppies I expect fair value for my money and not a song and dance accompaniaded with well shit happens.

I believe also you should be compensated. A verbal contract is as binding as a written contract as long as it's not for REAL ESTATE.
It's easy for those that didn't get the shaft to say,count your loses,or would not expect compensation. I WOULD WANT COMPENSATION,, AND YOUR ENTITLED TO IT!!!!!

I think it all boils down to people's integrity. The RIGHT thing to do would be to give the stud fee back but that seems to be the problem with people anymore....no one wants to do "the right thing" but yet when they get taken for a ride their the first ones to start stompin around ranting.
I just wondered at what point does one say "is the money REALLY worth keeping???" In this case I doubt the stud owner has any intentions of paying you back unfortunately. I like how they said "remind me what happend again and "we'll see" if we can work something out" ??? WHAT??? LOL They may as well said "screw off""! People just kill me!! Just take it on the chin and move on, not more you can do without aggrivating yourself more over it. Next time written contract!!! Never know what can happen so better to have something in black n write to "remind people" when they get that selective memory loss.
