ARIZONA MANDATORY SPAY/NEUTER BILL INTRODUCED

A bill mandatory spay/neuter bill has been introduced in
Arizona.  It has not been assigned to a committee at this
time.  As soon as it is assigned to a committee, I will get

Louisville court fund

In Louisville, KY legislation has been enacted which is clearly not 
pro fanciers, breeders or responsible pet owners. Many other local 
areas and states are considering or have passed similar legislation. 
All this IS changing the face of dog/cat breeding and pet ownership.  
While we do need responsible laws to protect animals and our 
communities, the flavor of the current wave of legislation nationwide 
is definitely aimed in the wrong direction.  Read for yourself at

Will the State of Tennessee's membership in the list of states that are considered "one bite" states be lost? In these states, a victim of a dog bite must prove the dog bit someone previously in order to sue for punitive damages or demand that the accused dog be destroyed. At present they can of course sue the dog's owner for liability, but Tennessee places a cap on general liability of $10,000.00. A recently-filed bill will make it possible for a person to sue the dog owner for punitive damages if the owner's dog bit them while the dog was not on its owner's property. Hmm, let's be very watchful of this one.

Will the State of Tennessee be successful creating a public list of convicted animal abusers (dog fighters included) as many states have done with convicted sex offenders? I personally have no issues with this one.

Will the State of Tennessee be successful in its efforts to seize the property owned by those convicted of dogfighting or other forms of animal abuse? Hmm, I like the original intent of this bill, but let's watch this one as well to make sure its definitions of abuse are as it is intended, to punish dogfighters and those who are neglectful.

AN ACT to amend Tennessee Code Annotated, Title 39,
Chapter 14, relative to pit bull dogs.
 
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
 SECTION 1.  Tennessee Code Annotated, Title 39, Chapter 14, Part 2, is amended by
adding the following new section thereto:
 § 39-14-215.
(a)  As used in this section, unless the context otherwise requires:
(1)  “Own” means to harbor, keep or exercise control over the dog, and
"owner” means a person who, at the time of the offense, regularly harbors, keeps
or exercises control over the dog;
(2)  "Pit bull dog" means any pit bull terrier; and
(3)  "Pit bull terrier" means any American pit bull terrier, Staffordshire bull
terrier, American bulldog or American Staffordshire terrier breed of dog or any
mixed breed of dog which contains as fifty percent (50%) of its breeding the
breed of American pit bull terrier, Staffordshire bull terrier, American bulldog or
American Staffordshire terrier, so as to be identifiable as partially of the breed
American pit bull terrier, Staffordshire bull terrier, American bulldog or American
Staffordshire terrier.
(b)  It is an offense for any person to knowingly own a pit bull dog in this state.
(c)  A violation of this section is a Class A misdemeanor.
(d)  In addition to the penalty imposed in subsection (c), the court making the
sentencing determination for a person convicted under this section shall order the
person convicted to surrender custody and forfeit the pit bull dog or pit bull dogs if the person convicted is the owner of the pit bull dog or dogs.  Custody shall be given to a
humane society incorporated under the laws of this state. 
(e) Nothing in this section shall be construed to prohibit prosecution under any
other provision of law.
 SECTION 2.  This act shall take effect July 1, 2008, the public welfare requiring it.
