Jonah, thank you for the link. I know everyone here and elsewhere did what they could to save this dog's life, but yet obviously to no avail. One could only hope the illegal immigrant who initiated this defense by the dog is not still Stateside and sucking the lifeblood from our country.

Aggravating that this issue will be used to politically debate immigration. When this first came about all I thought........if I were the owner (the woman, that is), I would have said the gardener and I were yelling at each other......He was there too early....We were fighting....and when it got physical, I fell and cried out......Congo came to my defence. Damn them all. The gardener should never have come on the property to begin with. Sorry if I sound corrupt.....but, I'm sick of all this constant BS. I would have said I want to press charges........then backed off if I felt my dog was safe. My word against his. Shoot me.
You can see the dog is no angel. He's protective and territorial. The gardener knew it and just didn't give a shit. Between him and the non-running-out-of-shower-immediately owner, this dog is toast. Those poor children.

I really feel for the kids as well, very sad for them. All I saw was the video, but when the man said "they hit my dogs and grabbed my wife" how can this dog be sentenced to death if it was just defending itself and its owner? I may be missing part of the story.
Reminds me of something that happened at the clinic I work at; a gardener was weed whacking and taunting the owner's boxer (who was kenneled) the boxer had enough and ripped the chain link off and went for the gardener, the gardener used the weed whacker to defend himself, the dog looked like he had recieved 40 lashes to the face, very sad! The worst part was this was typically a very sweet dog, never showed any aggression so you know that guy had to be really aggrivating him...

Folks,
There are many judges who are not qualified for the most basic and inconsequential decisions. I do not care if the instigators are citizens or illegals. If someone antagonized MY dogs let alone hit them, I would make sure that they did not receive MONEY for their stupidity. If the allegations are true that he hit the dog and grabbed the woman, he should be charged with assault, should pay for ALL expenses incurred, then deported with a permanent record as a violent offender who is not to be allowed into the country again. We have enough of our own scumbags to adjudicate without processing the riff raff from other countries. Best Wishes, Jonah

As I understand it, the gardeners were invited on the property, then the owner told them to sit in their truck while he took a shower. Granted, they shouldn't have gotten out of the truck, but wouldn't the prudent course of action have been to either make them wait outside the gate or put the dogs up while he showered?

Illegal Immigrant or not, this is BS. If someone hit my wife and or my dog I would make damn sure he was charged with that. The dog did what he was supposed to do. This is a very sad story, all most people want is a dog that is good around the house and kids that will protect. This dog does this and he may pay with his life. I just hope the fact that this guy was an illegal does not overshadow and take away from what really happened. That should not matter, just the actions plain and simple.

This judge is doing wrong, Kongo did what he supose to due protect the family and home , It's ok shooting and killing some one on your property to protect your family, but it's wrong when your dog does it, What kind of justice is that? The gardner did wrong in hitting the dog and the owners wife. This judge needs to be taken of the banch.

I think someone may have hit the nail on the head during that video! If the dog has good ball drive (he is playing ball in the video), the the Military test him. It is only a prejudice situation because of the humans, not the dog saying, look he's an alien, let me bite him. Border Patrol is always looking for new dogs :o) I think 1) if the people hired an illegal alien to work for them they need to be penalized 2) they neglected to put the dogs away when they had people outside in their yard. Unfortunately we will never know the entire story as to what happened so I can't say whether that family should own the dog. At the beginning of the video he was muzzled and lunging at the cameraman so who knows. We just had a situation like this in my town and we had to have the dog destroyed after his 2nd reported bite (there appears to have been others). the people would invite company over and let the dog (a 102 pound GSD intact male with no training) stay tied in the front yard where he could reach all people who drove into the driveway and couldn't get to any doors without walking through his area. He would sleep in the garage and when someone came into his area not seeing him, he would bite. the firsttime was a bite, the second was an attack (8 different bites from the left arm to the lower left thigh). I had to make the decision to deem him dangerous and have him destroyed. Come to find out, he is from 3 generation of guard (junk yard) dogs. it's never easy and the dog ALWAYS PAYS the ultimate price for the lack of responsability by the owner. It's a shame.
