Okay, so this is in regards to a Jack Russell Terrier and not a German Shepherd, but any help / suggestions in this matter would be greatly appreciated.
I purchased two Jack Russell Terriers from a breeder in IL. I bought from this breeder becuase I knew her by association, was searching for a pair of working hunting Jacks, and had heard nothing negative about her or her dogs. The purchase was actualy made through my husband, but since I was stationed in IL at the time, I was able to pick the dogs up in person.
I picked the male up first. He came with a puppy starter packet, info, vet records and pedigree chart.
About a month later I picked up the female. They were supposed to be from unrelated lineage to be a compatable breeding pair (as per JRTCA regulations against linebreeding). The female came only with herself . I met the breeder in person when I picked her up. Later, when I wanted to get her papers and info the breeder can't find any record of her, and doesn't recall our meeting. She asked if I was sure my husband had bought the pup from her. When I sent an e-mail reply, describing the spot we met (a halfway point between my town and hers), and the color of the Jeep she was driving, she didn't respond to my e-mails. I have not heard from her since.
I would really like to get this straightened out.
Suggestions on how to handle this?

Wow. Where does one begin? You received your bitch and the breeder received her money. But there were no papers as promised. Yes this sometimes happens in the GSD world when dealing with unscrupulous breeders and importers when a dog is shipped Stateside from Europe but it seldom happens on the same continent-much less the same state.
Do you know what I suspect? One (1) of two (2) things. First, that this bitch was from an unregistered litter (accidental breeding or unapproved breeding) and has no papers. Second, that this bitch may have been stolen, or accepted for a very low price from a backyard breeder and then sold to you. You have the bitch; do you have any idea who the sire and dam are supposed to be? I truley suspect the first scenario to be true.
I presume the J.R.T.C.A. is a breed clun similar to the G.S.D.C.A.. Is this breed club recognized by the A.K.C.? If so, perhaps you can file a complaint with the first entity and possibly the second. Expect nothing but static from the A.K.C.. The A.K.C. barks loud but whimpers and hides when asked to investigate a shady purebred dog issue. Doe the J.R.T.C.A. have a website where one can make inquiries?
I have one (1) final question; did you pay the breeder in cash? If you did, then I fear there is nothing that you can do. Essentially it is your word against her's, and we know how weak that is in our civil court system. I do feel for you, as unless you can get this person to admit that she sold the puppy to you then there is nothing that is worth the time and money involved to straighten it out, aside from physically punching them out.

Or #3, the two dogs are related and she doesn't want to admit it since you specified unrelated. Good luck and I do hope it works out okay for you.

The idea that a breeder "can't remember" a litter or puppy is pure BS. Can I ask why you didn't pick the dogs up at her kennel?

It was a long drive to her kennel from where I was stationed in IL. Due to the length of the drive, meeting half-way seemed logical. I'd already picked up the male with all his papers at the same location the previous month. I was not expecting any difficulties with the female.
I could suspect the bitch is from an unregistered litter. The first pup was paid for via Paypal, and female was paid for by personal check. I was going to run a trace through both avenues, and I'm trying to track down the earlier communication my husband had with her. He'd arranged this; the pups were technically presents for me as he paid for them. I was not involved in the bulk of communication, but the breeder won't respond to contact from either one of us.

If you paid with a personal check (and I'm assuming it was cashed) you can confront her with that and if you get nowhere, take her to small claims court. You have proof enough and she should hand over the papers or come clean with why she can't.

How about you do a DNA test on both dogs? It doesn't cost that much and it might quickly refresh their memory. The fact that you can verify both payments is a big plus for you. A verbal contract is just as binding as a written contract for "everything except real estate"( I have a legal degree). You may not get your papers on the second dog, unless the payment was the same amount, but chances are "Both" dogs are not who they claim them to be), in which case your papers will be worthless anyway.
You can than report them and their fraud to AKC, which will strip them of their right to register any dog. Sometimes the self satisfaction of "getting EVEN for someone playing you as a fool, Is Worth Its Weight In GOLD"!
Or, as others have stated, pay them a visit with the boys(I also happen to be Italian!) They will probably provide you the GREATER SATISFACTION!!!!!
