Dead dog barking: Should this pooch perish for chomping a gardener? | |
By Rick Murray | |
Those of you who don't know about this please read below...this is from a newpaper in NJ...... PRINCETON TWP. — Hundreds of protesters are expected to rally here Tuesday in a last-ditch campaign to save Congo, the German shepherd sentenced to death in local court last June for defending his family. “He was nicknamed by everyone as the ‘Happy Dog,’ ” said Kat McAlfee, a local animal rights activist. “We want to put pressure on the judge to change his decision.” The rally will be staged at 10 a.m. outside the Princeton Township municipal court, 400 Witherspoon St., where Judge Russell Annich is expected to officially record the death sentence he handed down Oct. 31. Congo’s owners, Guy and Elizabeth James, acknowledge the 18-month-old shepherd, as well as his mate Lucia and their four puppies, attacked two panicky gardeners June 5 at the James’ 4-acre property here on the 1700 block of Stuart Road West. But James, a 46-year-old businessman, says his dogs attacked only because one gardener gouged Congo’s puppies with a rake, while the other gardener “manhandled” Elizabeth James to the ground. “We’re going to fight to the end to save Congo’s life,” said James, a father of four. ‘All lies’ Local Animal Warden Mark Johnson says that story has too many bite marks to hold water. Johnson insists Congo was wild and vicious, inflicting multiple bites on illegal immigrant Giovanni Rivera, one of the gardeners. He said the other dogs are dangerous but can live if they remain muzzled. “Congo happy? It’s all lies,” Johnson said. “This dog attacked for no apparent reason. He’s dangerous.” The gardener, Johnson said, “was severely mauled, receiving bite wounds to the head and all over his back and legs.” For his part, James remains irate and has vowed to appeal Annich’s decision in Superior Court. “Rivera manhandled my wife, Elizabeth. And now my son, Benjamin, has nightmares and cries every single day,” James said. And so, more drama may unfold in a saga that has drawn widespread attention on TV and radio. “A radio show on 101.5 FM has been running a poll that has 35,000 in favor of Congo, and only 1,000 against him,” said James, who was interviewed by Philadelphia TV’s Action News yesterday afternoon. Bizarre twists The case has included bizarre twists and developments, such as a stray dog eating defense witnesses’ statements, an expert medical witness, and private investigators interrogating pound workers. Attorneys have already arranged an insurance settlement of $250,000 for Rivera, who has since recovered from his bite wounds and now lives in upscale Hamilton Township. Puppy strayed Rivera and his four-member crew created problems from the start that June morning when they arrived at 7 a.m., an hour earlier than expected, according to James. James, who speaks Spanish, sa ![]() by Rezkat5 on 13 November 2007 - 22:11 This happened just south of where I work and the "story" seems to keep changing. It's just a bad situation, there's a picture of him in a local paper and he seems happy enough. He's been in a local shelter since the incident happened.
by gsdlvr2 on 13 November 2007 - 23:11 The family attorney needs to appeal the decision in court. Without that I doubt all the protesting will do much good. Sad to say, because this dog was just doing his job. IMO
![]() by Rezkat5 on 13 November 2007 - 23:11 I agree too, that I think that this was a somewhat provoked attack. ![]() by Rezkat5 on 13 November 2007 - 23:11 http://www.pacpub.com/articles/2007/11/13/the_princeton_packet/extra/doc473a1e02bdb6d890058644.txt http://www.pacpub.com/articles/2007/11/10/the_princeton_packet/news/doc4733d1bd1bc28219072988.txt The second story has a picture of Congo, this is the local paper that seems to be following the story quite closely.
![]() by AgarPhranicniStraze1 on 14 November 2007 - 01:11 I just wanna know something...why wasn't this "illegal immigrant" deported when they found out he was an illegal, and why in the hell did he "man handle" the owners wife? What was done about THAT? Isn't that assault? I just can't believe that if this story went down the way the paper says that the judge and everyone else involved don't understand the dog wasn't the one in the wrong. That's terrible this dog must lose his life because he was protecting his family.
![]() by Rezkat5 on 14 November 2007 - 01:11 The original story which I posted a while back and cannnot find didn't mention anything of the wife being involved and ending up on the ground. I do believe that the landscapers are in part at fault here as well as the irresponsible dog owners, meaning unlicensed/unvaccinated. Who in their right mind enters a yard knowing that there may be a German Shepherd there, one nevermind five whom I'm sure were not quiet either. Any dog actually, people are just incredibly stupid! It's a very big fear of fine that some stupid idiot will enter my yard even though I have signs up. We in being responsible pet owners need to have our GSDs vaccinated against rabies and licensed. Rabies is in the area of where this happened. Only recently there was a cat that tested postive and a goat, both in the area. Unfortunately none of us were there to see what really happened. ![]() by AgarPhranicniStraze1 on 14 November 2007 - 02:11 Rezkat5- I did not realize the owner did not have the dog licensed or vaccinated. Oooh that's not looking very good on them does it? Was this dog titled by chance or just a family pet? Just curious if authorities realized the dog was trained to bite and kinda took that and ran with it to get their execution signed faster? Before we got our kennels up I feared the same thing you do with someone being stupid to just open my gate and enter despite the fact I have a sign. I don't do the "beware of dog" thing, or even the "security guard dog" I just have a cute sign with a GSD that says I can make it to the fence in 2.8 seconds, can you. That's all. I'm not telling you I have "trained dogs", I'm not saying they are vicious as my dogs are not, but I am telling you that common sense tells you there is a BIG dog behind this fence where he belongs and you do not- should you enter on your own stupidity and you get bit then I guess you have some explaining to do as will I. But at least I am going above and beyond to protect even the stupid and couragous. lol Now we have kennels so if you got bit in my yard after going through a 6 ft fence AND dogs in kennels then you definately deserved it and I feel I need to explain NADA! There must have been some altercation for the woman to have been taken to the ground. But no one went into that part. Wonder why? by Optimistic2 on 14 November 2007 - 02:11 I called today and gave my input . I let them know I had a dog (Collie) some years ago that bit a neighbor kid who threw a brick at her. The boy got bit. The dad wanted our dog put to sleep because he said his son was throwing it toward the dog not at her. By the way our dog was on a leash at the time in our own yard. The Police Dept and Animal Control came out and checked her out. They could see she was not vicious. They had me quarantine her myself for ten days to be sure she did not have rabies. Never heard a word after that. That was in Oregon, the same state I now live in. I also told them Congo did what he should, protect his family. (And yes, I would call the action to the female owner an assault by the yard worker-who should be paying them the $250,000.) During our conversation I asked her how many votes she had to Save Congo or not. She said she could not tell me. I asked her how many poll takers there were. She said she could not tell me, because there were too many to count. She said her phones were ringing too often to keep up. When my daughter called later, she said they were receiving too many calls and were unable to take actual messages, just the tally. Yeah! Save Congo! One of the radio stations had a tally going. (I don't think I am able to mention the station because of the rules, so I won't.) It showed 3% for the death penalty 97% for SAVE CONGO (I was included in this count of over 100,000) I am very optimistic and expect the judge to receive the same kind of tally! -Laurene
![]() by Rezkat5 on 14 November 2007 - 02:11 Some of the dogs, five total or something were in the the yard at the time of the attack, were not vaccinated or licensed. One of the articles states what the deal was there. I believe that Congo was vaccinated at least once. The landscaper did get chewed up pretty good and had to go through some absurd number of rabies injections.
