Just wanted to post a message that I have be burned by Grum Majestat German Shepherds in Florida.  I was sold a puppy that was diagnosed with severe hip dysplasia at 10 months (by OFA )bred by this kennel.  I was to receive a replacment puppy as per the written contract signed by me and the breeder.  I have waited 17 months for this replacement and now am being ignored by the breeder.  Just want people to know about this kennel and breeder.  Do not purchase a dog from them.

If you have a written contract, can't you take it to a lawyer?

I have started with the attorney general of Florida and will go from there if need be.  Just wanted others to know about this person.  Do not want others to go threw what I have been and will be going through.

IIts not the first breeder not the last that doesnt honor a contract....Nothing you can do.     I have a contract with a big named podium trainer, who everyone in the USA thinks hung the  moon.....he doesnt  ....he wouldnt even sign for the vets letter wirh rhw xray disc sent by certified mail to prove the hips were bad   and he had every excuse in the book....But his signature and the check deposited in his bank   even wont make it right....the courts want nothing to do with dog cases  and to have to travel over 1800 miles to go to court   ......got new for you      Barb W    it will eat you up in attorney fees and court costs.....

CANT TYPE TODAY,,,IN A HURRY...... A BREEDER CAN TAKE AS LONG AS HE WANTS TO REPLACE THE PUP, AS THE CONTRACTS DONT GIVE A TIME TABLE WHEN THEY WILL REPLACE YOUR PUP....IT IS UP TO THE BREEDER, TO DETERMINE WHETHER HE OR SHE HAS A PUP OF THE SAME CALIBER, SAME PRICE AND AVAILABILITY OF THE PUP TO GIVE YOU....AND THAT CAN BE 1 YEAR TO 10 YEARS....SO TAKEING THEM TO COURT IS USELESS....

THE EXPOSURE OF NOT HELPING YOU , IS THE ONLY THING THAT HELPS GET AN ANSWER FOR THE DEED....

POSTING HERE THAT YOU ARE UNHAPPY AND THAT MAY PROMP THE BREEDER TO MAKE BETTER ARRANGEMENT WITH YOU....NO REFUND   BUT MAYBE AN APPROPORIATE DATE WHEN YOU MIGHT EXPECT TO GET A REPLACEMENT......THAT S  ALL YOU MAY GET....AND MAY NOT GET THAT.........

Barb,

 I wrote you seperately as well, but wanted to add this as to the actual condition of the hips - can you post a digital image of this dogs' hips for us to proof that this is a valid claim.  I know you stated the OFA prelimmed them at 10 months to be severely displastic.  I have included a sample of a GSD with very bad hips.  (thankfully not one of mine, i pulled this pic of the internet way back when I was studying the subject.)

In addition, pls let us know if the breeder wanted the dog back in exchange for a pup and did you refuse? or was it initially understood you would keep the dog and would get another pup/dog from him/her in addition? 

example :  In my contract I make it very clear that the hips have to be rated at exactly ONE year (12 months) of age with the SV.    NOT the OFA.  Not before that date, not after that date, in order to obtain another dog pup for the warranty to be valid. 

 

I also want people to feed an approved by me food, and some additional conditions.  HOWEVER, hips like the ones seen here, were bad from birth and that can not be remedied.  Were both Sire and Dam hip approved as well?  Thanks!

Hi Barb,

  It is always sad when a young dog turns out to be dysplastic, all your hopes just go down the drain.   I am not familier with this kennel and do not know how large they are but is it possible that they do not have a replacement puppy for you?  I also guarentee my puppies with regards to the hips and offer a replacement puppy.  However there are times when I would not have a puppy to offer, even for 17 months.  If this kennel is reputable, again I am not familiar with them, as they should be if you felt comfortable in dealing with them in the first place.  Then my advice would be to remain patient and stay in contact with them, but not to the point of being annoying and harrassing.  I wish you the best of luck.

Kerschberger:    Just a question please.  Really none of my business, but you state exactly one year on your guarantee's.   Not before that date and not after that date.  Technically, is that possible, or do you not mean "exactly"?  How can the you (buyer) get an x-ray on the exact date, send it off to be certified, wait until it is checked and you (buyer) are notified, and then notify the seller (you)?  I'm just curious if that is even remotely possible.

In addition, it is a hardship for the owners to send it to the SV. That is only possible if they are members of the United Schutzhund Clubs of America or now the WDA. The SV does not honor xrays sent in directly without the involvement of these organizations. So, why not OFA? I know for a fact that the SV respects the OFA evaluations very much! Heck, at one point OFA was authorized to award a-stamps here in this country! But to each their own! I honor OFA in my contract in writing at any age, up to 2 years of age, for hips and elbows! I also spell out warantees for the different grades of HD! And I personally would prefer to replace a puppy as soon as possible, for the peace of mind of all parties involved! The only thing that is not possible is to receive a higher cost puppy, hence the wording: "of equal or lesser value" - up to the discretion and choosing of the buyer!
