I just read the email from the man that is selling the pup I sold him on March 09-07 and he said my contract wont hold up , and he is selling the pup for $600.00 , which is $100.00 0ver the price of what I sold it to him for...The contract states that he cannot sell or transfer dog without my written permission and It says that the name Tripl'H that states in the contract that it goes on the name of dog as I print it on AKC registration puppy , before the dog leaves premises...It is a dba in the courthouse in Galveston , and I know that is doing business as, but the contract says any attempt to remove it from the registration paper, seller may opt to take legal action,, Contract states that under no circumstance is dog to be resold or given to anyone besides the buyer without the sellers written permission. Under no circumstance is the dog to be euthanized without consent of the sellers written permission as we have seen over and over and over again and again mis diagnosis of dogs by Veternirian of all kinds and in many cities in this state.....

He put the pup up for sale on a site and I emailed him  He said he had the contract looked at and it wont stand,.,.a dba doent mean a thing....if I want the pup I have to pay the $600.00 as the contract wont stand    would someone please explain to me   Why in the land of this country do we have a written contract signed by both parties and he also verbally said   Ok this dog is for me   and I told him verbally to read his contract and that he cannot resell the pup    He has taken tripl'H off the dogs name and he is selling the pup to God knows who and I let him have open registration against my better judgement...I scratched through the sentence that said the dog is sold as pet registration and not for breeding and added a sentence at the bottom that said  this person , only on this litter pup, gets full registration on the male pup.   and signed it....

Go waste your time and money in small claims court. You may not win, but think of the gratification you'll receive from fighting this doer of evil.

 Moral of the story: Know who you're selling to....

Gee thanks Spook your words of wisdom really help. People lie or change their minds all the time. You can't possible "know" all your buyers unless they are really friends/relatives/or people from work who you spend hours a day with. Even then, thats not a shoe in.

Yellow, if it really is something you want to keep after, get your lawyer on it. Have him read over your contract and see what he says. Every state is probably different.

Contracts regarding the sale of dogs should be written by an attorney licensed to practice in your home state who is versed in dog laws and the nuances of dog ownership.  Don't do it yourself. The only way to be sure that any  dog you breed is registered with your kennel name is to register it yourself as the owner and then tranfer it to the buyer using the AKC registration form. It is illegal for anyone other than the owner of the dog to fill in any part of the name, that's up to the owner to do. I know many who do that, but if the buyer complains to AKC, they will allow the buyer to register the dog however he or she wishes and the name you picked will be voided.

I've never had a problem collecting on a contract and always got back the dogs the the buyers couldn't keep. Sounds like this guy wanted to make a few bucks by selling the pup for more than it cost him. Unfortunately there are people like that everywhere and sometimes they can fool even the most astute seller.  I was fooled too a few times and lived to regret it. Sorry that happened to you, YellowRose. I'd be pretty upset myself.

You're right 4pack. Pay a $1000 retainer to a lawyer so he can tell you, you really don't have a case. One of the casualties of breeding is the destination and treatment of the pups. The more you produce the harder it is to find viable homes. It's a fact of life. Now go stick your head in the sand.

Let's not forget poor everybody else who has to listen to your negative, non info containing posts. So glad to see you back. Not?

Some poeple would think it important enough to pay an atterney. I myself would chalk it up to lesson learned or just one of those things you can't control. It's not about sticking your head in the sand. We are all aware of the facts of life.

Spook I am done posting directly to you. Everybody already knows they will get nothing from your posts but a headache.

Yellowrose, sorry for your misfortune. He is trying to make $100, We all know he will lose money in the deal. He still has to feed the pup. I would hope continue the shots. I would go the small claims avenue. Good luck.
