Because you are totally ignoring the fact that just about everyone on here has said the shepherd dog's owners have been irresponsible.
Now this, Tantra, "How stupid could she have been to go ahead to kick and hit this dog while he is full of adrenalin busy with an attack" could be unfair. A GSD grabs your dog, it's hard not to panic, especially if you don't know dog behavior. Sure, I can envision the GSD coming up friendly, and a terrier, being a terrier, took offense and it was on. I'd go to battle for my pet, too. No excuses for the GSD owner - the dog was loose and not under its owner's control, so the owner is at fault. But the shepherd bit up the woman, no word on if the other dog was hurt at all. If you have the kind of dog that if a stranger hits it, it's going to go for the stranger and bite her 12 times, then you'd better be sure that dog isn't roaming around. Of course it could have been a total accident that the dog was loose in the first place, but that won't matter. The law's the law.
But still, the stock phrases uttered by the woman sure sound like she's going to insist on far more than her medical bills being paid. Hope I'm wrong, but we'll see.
Also, if I was the lawyer for the shepherd people, I'd make darn sure those 12 bites were all from the shepherd. Could be some terrier teeth in there, too. Everything's around the knees.

He comes up to her, all friendly like. Her dog decides to be nasty, and starts a fight with the GSD, who fights to defend himself. Then the owner is on him, and he turns on her, again defending himself from an attack. She's all bitten up, yes, but did he attack, or defend? And does a dog have the right to defend itself from attack? If the dog was friendly, and then suddenly wasn't, I'd sure wonder what the other dog did..GSD with dog aggression issues isn't just going to walk up all friendly and then attack, is he?
Still, the GSD shouldn't have been loose, it is the owner's fault, and I believe that all the "victim" is entitled to is her medical bills paid, nothing more. Of course, ambulance chaser attorneys are most likely goading her to sue, but that's not because she deserves anything more than bills paid..it's about money, and they love liability cases like that.
There was a comment on the story that said that the owners of the GSD shouldn't ever allowed to own another dog...I have to shake my head on that. How do they know that the owners just let their dog out to run? How do they know that he didn't escape a yard through a gate left open, or through an open door? Nope, it's all about screaming about how people shouldn't leave their dogs running loose...And as for never owning another dog...I've read comments on stories where people have argued that Michael Vick should be allowed to own a dog again, so these folks, even if they did let their dog run loose, shouldn't be kept from owning a dog again...
Brain is fried today after reading so much tragedy...there is so much of it around the country, and indeed, the world.
