The vet statement was that it was very painful for the stud and their was allot of blood.  It may be good for live coverage but doubtful for chilling.  The vet did not know the kennel had experienced this before with this stud.  The kennel is still advertising the stud for shipping chilled. 

The kennel will not negotiate anything and has said it is the risk of breeding.  I understand things happen but common sense is you have to have a viable product to begin with. 

As far as going to the stud.  I would not breed a dog that is in pain.  Nor can I find the owner because they have left.  And no longer returns emails or calls

My female has has a litter of 11 (A I )  one of 8 and one of 6.   She is in great health and is a good mother.  But not going to get a litter from bloody dead semen.

If the dog were in pain while breeding, he wouldn't breed. It is a voluntary process.  My stud dogs are bred and collected often - if they are not "in the mood" or don't like the vet for some reason, they simply won't "cooperate".  It is a choice that they have.   If the male is willing to be collected or to breed a standing female and physically able to do so, then I doubt there is much pain involved.  Blood in the semen usually means an inflamed or infected prostrate gland, or UTI.  If the semen was viable on collection, then there wasn't much blood or pain involved if any.

Wow ,Molly are you a vet?  That is not what the vet collecting said nor my vet both are certified breeding specialist.  I just want to be fair.  Not asking for anything other than fair.  So should I just let this go and hope the vets were wrong and the breeder is doing business fairly?

There seems to be allot of people who think it is not good practice....

What does your contract say regarding this issue?  If the contract is silent or states that the only remedy for a bitch not taking is to repeat the breeding with you paying the collection/shipping expenses then you are pretty much SOL.  If you don't have a contract you are again pretty much SOL.

As to stopping the breeder from breeding the dog -  what the heck is the vet doing shipping poor quality semen and collecting from a dog if its painful? Obviously this dog has had more than one collection and it seems they are still collecting the dog for its owner. 

If you feel strongly about this, post the stud dog's name and its owner so that people are aware of a potential problem with using that sire and can inquire with the breeder prior to entering into a stud contract as to the semen viability.  If you don't want to stick your neck out that far then I personally fail to see the purpose of continuing this thread but that is just me <shrug>

No not a vet, but a breeder who has worked with many many MANY vets collecting stud dogs, and also many many MANY stud dogs of all ages - so I do know what I'm talking about - do you think all vets know everything about breeding and dog behavior?

Thanks for all your ideas. I did try the BBB but she has left the state. She is full of lies and half truths. The kennel name is Fraugengarten the stud is Carol Vom Arolser Holz also known as "T" and the breeder is Shelley Strohl.

Check out her web site it still says under studs: Discounts and lodging accommodations available for females shipped/arriving by land from distant states. No additional charge for shipped, chilled semen

She refuses to refund my money and says this is the risk you have when breeding. But I argue it is not a breeding if the semen is not good. The vet said it appears he has suffered with Prostitus for some time and was in pain during the collection. The vet report said the semen may be strong enough at the time of collection to get a female pregnant with live breeding but not likely with all the blood he passes. The vet  was one she picked, it was a breeding specialist clinic, and the first time they every met Shelley or "T".  I was told by Straws to Paws Clinic that they informed  Shelley that semen in that condition would not chill well and would most likely not be viable for shipping. Shelley charged me and sent it anyway.  Straws to Paws (obviously by their name) specializes in this. They did not know this was a repeat try and the first time failed also. I did not find out about his condition until after the second collection was shipped. My vet called her vet and we got a report sent to us. Since I paid for the collection and shipping (again) the vet released the info to me, as I was their customer.  I have about $1500. in this scam. Shelley had me believing all kinds of lies about her personal life and her dog.

I want to warn others so "T" does not get pimped anymore and I would like to get some or all of my money back.

I have All vet reports and papers pertaining to this contract.

Uhhhh: so why don't we still have the name of the breeder who sent him the dead sperm? Collecting a dog in pain is ok? Here we go again with the abuse...so tired of it....

As usual, there are two sides to every story, I'm too sleepy to tell all of my side tonight, but rest assured I will get to it tomorrow. 

I'd like to see a copy of that report. You might want to read your copy of my contract again too, especially the part where you have a whole year in which to bring the original contracted female, or even a different (approved) female back for a repeat breeding if the female fails to deliver two live pups. 
NOWHERE does it say I am obligated to offer anything more than two years after the initial shipping... which WAS live when it left. For all I know, the first shipping could have been warmed up in the microwave at your end. You did NOT tell me it was dead when you got it. You said "It wasn't in very good condition." For all I know you used it. I would have! How would the shipper know any different?

So--- Fast Forward Two Years-

You were asked on the phone by the collecting vet if you wanted the second sample shipped, when it was noticed to have a small amount of blood in it. You were also informed during that call that there was another female standing by in the room with her owner, stud fee in hand, hoping you would decline so she could use the sample for her female. I had promised you a second collection, even after over two years time, my dog by then 8.5 years old, and I stood by my promise. I did NOT charge you anything for my time and trouble, or the over one hour dirve each way to the repro specialist in NJ either, for that matter. It was your choice to go ahead and have the sample shipped, at your cost.with full knowledge BEFORE IT WAS PACKAGED, that it had a tiny bit of blood in it,  Had you declined, you would not have had to pay for collection or shipping.

BTW-  It took a grand total of about 20 seconds to collect T's semen. At no time was he in in any pain. That's a load of crap. He  didn't look like he was in any pain when he bred two females a total of 6 times, tied 30-60 min. each time, last month either.
If you don't believe ME, ask Steve Miller, whose excellent female, V Paula vom Conneforde, SchH3, KK1, is confirmed in whelp to my dog. I suspect Portia is also, but too soon for ultrasound at less than 4 weeks.

SO--- You wrote me that you demanded a refund of every cost associated with both collections, shipping AND the pre-breeding testing and miscellaneous expenses for your female, BOTH times, $1500 total... and, after consulting with no less that 6 well-respected stud dog owners, I declined.
So--- Here you are, Sue, another 6 months later, whining on this board. What happened? Bitch fail to concieve again?
... and who is Linda?
Oh never mind.

My advice to you, Gentle Reader, is---  Next time your female fails to concieve, don't wait over two years, till the stud dog has one foot in the grave and the other three on a banana peel, to ask for a repeat breeding.
