You are being taken to the cleaners!

NO Progeny on the ground yet......hmmmmmmmmm

I would say 2 live pups constitute a litter, I would never take money from someone that has not recieved anything

from me, so what if you got stud service, it's only stud service if it leads to producing a litter of at least 2 live pups.

Most people I deal with want to make sure your bitch has pups, after all, why even advertise your dog as a stud,
if there is no progeny to brag about, I'm baffled

If the stud owner wanted and agreed to take a puppy as fee for stud, then you owe them nothing. Not 1/2, not full, nothing.

If the agreement was a pup and there were no pups, I think it would be foolish to let them change the agreement after the fact.

Best,

Well, one thing is, once you take a sample from a stud, experienced people know NOT to slosh it about as it can cause damage. Even bubbles up thru the sample can cause damage and lower the potency of the sample. I would think it would be vial-packed or syringe-packed with NO air so that the sample wouldn't be damaged even if banged around a little during shipping...but I've never worked for a vet or anything, either. I've single-handedly AIed with both dogs on site with fresh. No prob-bitch had pups.

Is there maybe an issue with the packing and shipping causing the damage to the sample and thus making it arrive significantly lower in numbers than when it was originally taken? Fed Ex doesn't always handle their packages carefully. They throw them, bump them around, etc.

And like Shelley says, well, even if it might not seem very useful, why not go ahead and do it since you've paid for it and see what happens? You might just get something.

I've never shipped semen although it has been requested. If both vets handling things on both ends aren't the most experienced with what they are doing, then it just causes more problems.

Do you have a signed/written contract specifying original details(stud fee for puppy, not money)? If you do, then don't fret it. No pups=nothing to anyone else. If they sue, they get what you got-nothing.

Why are you getting a rebreeding when you never paid for the first breeding? If you said you would pay, be true to your word and pay them. Consider it a lesson learned, and go pay $1200 for a really nice, titled, proven stud.

I still don't understand where the stud owner gets the $2K figure, especially if YOU paid for the collection/shipping/expenses.

They said a law suit would damage their dogs reputation!

You just made the opening statement  here:  They are really bullying me ant threatening me with punitive damages of $2000 for breach of contract.

How are they going to get punitive damages from you if THEY don't take YOU to COURT? Won't that hurt their stud dog's rep, too?
Shelley, I think that's just an amount the stud owners apparently threw out there to make everything sound scary and worth their time. I don't think the $2,000 figure applies for anything else.

Wowsa! $2000 stud fee for an unproven sire?!? Sweeeeet! Here I was thinking I would have to WORK for a living. I oughta just set up a slick web site and pimp out my pup's juice for two grand a pop. Seriously, I hope that you will make good on your agreement and attempt a different strategy next time. Chilled or frozen semen has been proven to produce smaller litters than natural breedings. If I had a female to breed, I would avoid the chilled/frozen route, especially for an outrageous price like what you paid. I hope you have better luck the next time. -Yvette

I think I paid $350. to breed to Fero... about the same for Jago. (+ the trip over and back of course...)
That must be one hell of a dog. LOLOLOL
