One more thing, I offered a replacement pup (I must be crazy), but the person refused saying they did not wanting to wait the 1.5 years until I get my two young bitches hip certified.  In the mean time this person went out and bought a new puppy from another breeder.

I am sorry you are going thru this. Unless the owner had blood work done and/or a necropsy I dont feel that you own them anything. Although I am not a vet, I  do not feel that this was anything genetic. I honestly dont think that there is anything that the owners can do legally either. Afterall, they didnt take the dog to the vet for 3 days... If they go to court they would be the one in trouble.
In the end it is the dog that suffered. If they had actually taken the dog to the vet when it should have gone they possibly wouldnt have ended like this at all. To me what they have done is neglect. They should be the one that is being sued IMHO.

Also, it was my vet that the owner took the puppy to see.  She uses a different vet in the area.  I called the owners vets office inquiring about the puppy's general health during its 8 months of life and they refused to suppy the info stating it is private.

I would keep a standing offer for a replacement pup.  It is not worth having your name raked through the mud.  That is way more than reasonable.  Sounds like they are way too cheap, by .

If I were a breeder, I would not trust them with another puppy.

I think is would be said and done, since the vet provided you with very interesting information.....Did the vet give you a definite reason for the puppy dying?  Also, the lemon law in this state applies only if the situation can not rectified... which in your case you did attempt to make it right....I would send them a letter, registered return receipt, making them the offer of replacing the puppy.....This would be an attempt in good faith to work it out....Request they answer you the same way, by registered mail...That way all correspondence  will all be documented.....I bet you don't hear from them again....

I think they just want to try to get from you, the money they spent on the other puppy....

I am so sorry this happened to that poor puppy. There is no way I'd give this grossly neligent and dishonest person a replacement puppy. If it were me, I'd tell them that I am considering reporting them for gross negligence.  JMO Char

 First of all..contact the vet and ask for a copy of the vet records..IF the vet is bound by law and cannot give you then certify letter the owner of dead puppy and ask for a copy of the vet records with the vets signature and a notary stamp by a notary that this is the dog and puppy in question..

Chance are they are full of it....ANY ONE can threaten you ....THEY have not a leg to stand on..DID YOU SELL with a contract????

LEMON law does not apply to a puppy in the state of Texas.

State law where you live is binding..THE puppy owner has to prove ...with out any doubt the dog was diagnosised with or of or by the Vet attending the pup when it died..

YOU ALREADY KNOW the vets decision. SO go about your business...SEND a certified letter requesting the VETs RECORDS AND THE VETS DIAGNOSIS...

END OF THE PROBLEM....YOU WILL NEVER HEAR FROM THEM ..SO DO NOT GET ANY MORE UPSET THAN YOU ARE..

START A FOLDER WITH ALL PHONE CALLS , DATES ETC FOR YOUR OWN PEACE OF MIND AND THE DATE YOU TALKED TO VET AND ALL PAPERWORK....ASK VET TO SEND YOU HIS STATEMENT...HAVE IT AND ALL CONTRACTS, BILL OF SALE IN A FOLDER....

 PLEASE DO NOT GIVE ANY PUPPY FOR A REPLACEMENT...YOU HURT ALL OF US BREEDERS WHO DO GO BY THE LAW AND THEY ARE NEGLIGENT IN THE FIRST , SECOND AND THIRD PLACE.

  I would never let them have a dog from me...WHAT do you mean drag your name thru the dirt...Every business person in the world has a reputation..If your reputation will not stand against one DEAD pup that you already know was not genetic or by the vets admission they ask him to LIE and FORGE his name on a document,,,then you do not need to be in this business....


They are dishonest people..NO pup  no  no no no........Right is right and wrong is wrong...THIS is what is wrong with AMERICA now...we let liars and  people with crooked ways get what they want any way they can get it while those of us who die by our HONESTY,,have to work twice as hard...
