who is the breeder we need to put all bad things happing in this boared so othere will not fall at the seam mistake

i really think you should contact AKC and see what they say, and then i would look into getting your money back through court..
it does sound like you are out quite a bit of money.
i would call him and tell him if he does not refund your money you will have not choice but to take him to court,
maybe then he may give you the money back , as he know he is the one at fault here.
i sure would like to know who he is ?

You might have several courses of action.
1) AKC
2) Postal Inspector as in whether mail fraud was involved
3) Local attorney for advice on contract law
4) Web site; Just Answer and ask for Gloria M for legal advice at discounted rate
5) Peer presure form other breeders on this breeder.
6) Better business bureau where the breeder lives
7) Contacting local law enforecment where breeder loves to see if there is a patern of abuse and fraud
8) Contact local attorney general in state where breeder loves same as #7

name of breeder and stud dog, please. You can get something done if you do something about it. Don't let scammers get away with it - or allow this to happen to someone else!

I think maybe you should go after the vet because if the vet sent you dead sperm, then the vet also has a response ability.
Knowing she sent you a dead product. The vet could put that on her insurance and they would give you back your stud fee, collection charge and shipping fees. The vet has more to loose than the breeder. So let vet go chase that breeder down. I know some one that had a similar thing happen except the vet had package the sperm wrong and it arrive completely frozen twice and could not be used. That vet did put it on her insurance and the bitch owner was paid all his charges that he had spent for the sperm.

It was FedEx overnight chilled. So no recourse there. I am checking on the others ideas. Thanks for the ideas, any help is appreciated. The kennels name will be here yet today.

basically if the vet gave you a statement that the sperm was not viable before he shipped it, he's liable for fraud along with the breeder. Somehow I doubt any vet would speak to anyone about that true or not, so I doubt there is any statement to use for that.
Stud fees are normally paid up front of a breeding. Collection/shipping costs for shipped chilled or frozen semen are normally charged in addition to the stud fee (in advance). It is known that breeding AI with shipped semen is more risky (for missed pregnancy). Not all stud dogs' semen ship well - even if the semen is viable at the start things happen, temperature changes, handling and etc can cause it to "die" en route. Some stud dogs ship well, others not so much.
The normal guarantee for missed pregnancy is a return breeding - you did that - it is also normal to be charged the collection/shipping fees again. So she missed again - has the breeder offered for you to send the female for a live cover breeding? Has the stud dog sired other litters with other females live cover meanwhile? If so, his semen is just fine, just may not ship well.
If I were you I'd either cut your losses and go breed another stud dog, make sure your female can get pregnant in the first place - maybe she can't! Or, send her/bring her to the stud dog you've already paid for, and get her bred live cover free of charge. If you do this request a current semen evaluation (written by a vet) or proof that there is a female who is pregnant now or recently whelped a litter sired by him.
