Yeah that's harsh.  Bad situation all around.  I can see that happening in any neighborhood, unfortunately.  People don't expect to face a pack of dogs when they step in a yard.  I remember one day I was in my back yard pulling weeds with my dog running off leash and this guy just walks right back in my yard to me like he owns the place.  I have a large yard - he wasn't just stepping behind the house.  Chaco was less than a year old and still very "puppy" in his mentality (@%!#$ DDR blood) so he didn't fire on the guy.  The guy was looking for work and I politely listened and held Chaco's fur saver until he walked off.  The story might have a different ending if that happened today.

I hope the guy who was hurt recovers and I'm sorry to hear of this tragedy.

Yes, a bad situation all around.  But again, there are so many things missing from this story.  And how convenient that there are already attorney's involved!

iF YOU DO NOT KNOW THIS YOU SHOULD. I have put the gas comany and the electirc company on NOTICE, that I have dogs, and the breed of dogs and do not enter under any circumsatnces. They have this in their hand computer, and I called this in, When they came to read the meter, I made them show me that it is in the handheld. I documented the meter reader, date and time I checked it and called it in.

Years ago, I had an idot meter reader, who had that info in his hand held, and still entered my yard. Gates were unlocked, kids took out bikes. I was taking a nap on the couch, all of a sudden the wall were the dog door was shook like a Earth Quake. I jumped up and realized my rottie went thru the door and GSD already outside. I thought maybe neighbor kids got in, I ran and to the slider door and screamed plotz to a charging full grown male to give me time to access the situation, There standing is a stupid Meter reader, I asked what the hell was he doing back here and saw his Hand held and asked him to read it to me. It was in there, asked why was he there then, he told me "he likes dogs and is not afraid of them and understands them". I told him off and he did not understand one dam thing about dogs. Called his Super and advised  how dumb can he be. I was so thankful, for a large yard and trained dogs.

I got thinking about this and remembered a MT Law I had read some time ago. I have posted my property, not my yard but the perimeter and points of entry. I don't know if this law would cover workers for electric or gas, but we get our own propane and the meter for electric is on the pole outside of the yard... but if I have read this Law corectly #7 states you can't be held liable for injuries. Maybe this will help in some cases.

I am not an attorney, but I think Utilites have an implied consent becuse they have an easment on your property. Here in CA, you will see it in fine print that they have the right to enter and any dog bite is your liability. However, I would think thta by having the hand helds and putting them on notice of what you have and a do not enter, would give you some defense.

Yes I think you are correct. Our meter is on the pole outside of the yard though. One meter reader used binoculars and stayed in her car. I did have a guy from the Power Co. come up recently and said they wanted to come thru to trim tree branches. I asked him if he would please call before coming in case the dogs were out with me. So he punched something into a hand held he had and confirmed he put that in it. I really don't know if my dogs would bite anyway. Just 3 now... lost my old girl on Friday. The pup is just 6 months, then Ivan almost 3, and Yette (who would be the most likely) almost 10 and gimpy from her elbow. Course my sons dog can be a little twit and she is here alot.

Here in my town , we just had new electric meters installed and the electric co reads my meter from the office every 20th of the month....I hd a locked gate and have always read myown meter as they were not perimitted inside my locked property nor did any of them want to come in my property......glad they went to this method......saves me a lot of worry for rthe man that cant read the inserts on his hand held that says      'DO not go on this property....."  Happened in Galveston to a couple with two shepherds and the Insect terminator   went over the fence because it was locked and he needed to spray the yard...He actually climbed over a locked gate....how about that.......end of Terminex contract and hes lucky not to be carried out in a black bag.....Dax was in the back yard behind an 8 foot cedar fence locked and he couldnt climb over that...they billed my friends for the service and you should have seen the fireworks...when she ask the office supre....how did you spray my yard with the gate locked.??????The  service was suppose to call owners before they got to their house and ask for them to unlock and put dogs up...they own their own business, and can come home to do that......and always have...People are ignorant and ignorance can put   us in jeapordy   .....and we pay the price.....it cost a lot of money to hire an attorney to get you out of a llibel  dogbite case...when its not your fault.....
