Just a warning to anyone out there who cares to know....  I did not know !!!!!

Anyone at anytime buying anything from you... If they pay with Check and then stop payment on it at their bank there is NOTHING you can do,  you can NOT go retrieve YOUR merchandise no matter what it is,  and you can NOT have them brought up on Theft charges (even though that is exactly what it is) 

Your only recourse is to file a "small claim" in the courts, or hire an attorney and pursue a "Lawsuit"  which of course will cost YOU !!!

Just an FYI   wish someone had told me about it !!

You actually accepted a personal check and allowed the person to take a puppy without waiting for 10 days to clear?

At the shelter,  But yes I have always accepted peoples checks for our dogs too. 

I try to believe that people are Honest, and have some Nobility.

I havent taken a check for 15 years   ,,,I take a check for a deposit and that is it...Im not interested in being a cop or a detective any longer...been there done that.....i would nt take a check from the Pres of the Usa and its a matter of ,,,I dont have time to worry , wonder and wait and then   hours of running down the people  , and then the law of the Stop check matter and people will try any way they can , to get something for nothing....I treat all alike ...one rule for everyone...Never had anyone balk.....never had any deposit checks bounce.....

Ive managed 6 retail stores and owned a large independent auto garage,and Ive seen what bad and insuffieient checks can do to a business......charge cards eat up profit and so do insufficent check bouncers.......

Nothing goes until the check clears and cash in hand.  I didn't think people would even consider that anymore with all the published check fraud and fake money order/cashier checks being discussed all over everywhere.

I do take cheques for my puppies.  I've always felt that if I did not trust someone enough to accept a cheque from them, I shouldn't be selling them a pup in the first place.  Only once had one bounce and the person who gave it to me had visited, explained and given me the cash instead before I even got notification from my bank. 

We do live in a less honest world though and I never accept cheques from people claiming stray dogs since I got burned once and my business partner once bought a dog for cash and the vendor checked all the notes with one of those pens for detecting forgeries!

Well I suppose I'll spill the beans,  Yes the first time I had ever heard of this it happened at the shelter but more recently I had it happen with one of our babies.... I am so sick over the whole thing !!

guy bought this pup,  I really thought these people were nice people,  they came here, I explained everything about the paperwork, Microchip, contract, yada yada...  He gets pup home, and pup experiences some diarhea and mild vomiting,  I recomend they take to the vet,  vet tests for parvo,  with a vaccine 4 days earlier the titers were high giving a false posative test, (per that vet)  I called my vet immediately when purchaser told me about this had him come out was going to have them run parvo on every pup,  my vet refused,  saying they all look good and it would be foolish waste of time, effort, and expense, he advised I keep a close eye on them and notify him immediately if any of the pups appetite changed yada yada... 

ok so when guy calls me I tell him I think it's due to the vaccine but he has some options,  he can bring the pup back and I will replace her,  or I will hand him his check back,  He said he did not want to waste the gas/time to bring her back he just wanted to treat her there,  I advised that if it is truly a case of parvo that the expense could be very great and that I could NOT assume that expense that I could treat her here with my vet MUCH cheaper and would preffer to do that... he continues that he wants to keep her,  the vet explained to him that likely the positive result was in fact due to recent vaccination blah blah blah.... I called the vet daily to inquire of the pup,  Then he calls on the 2nd day,  pup is home bouncing around, playing, eating yada yada,  I inquire of the bill on the pup, he says 725.00 I go on to say ok I'll pay 1/2 of the bill just to be right about the whole deal,  so I'll go ahead and cash the check ( I had held on to it just in case things went badly) and then mail him a refund check of 350.00.  He goes on to tell me that I can not cash the check because he put a stop payment on it....  and the battle is NOW on.... I don't want to cash his check,  I don't want a new check,  I want MY dog back,  this guy I also found out lied about the vet bill,  the bill is only 459.00 I have a copy... then I find out that he took us OFF as the secondary contact on the Microchip which we are to remain on the Microchip as the secondary contact for the lifetime of the dog !!!    I offered to pay the entire vet bill on the pup (when I was told the bill was 725.00) and would come and pick her up and give him his check back,  he refused !!  went on to say if I tried to take the pup back he would have ME arrested for theft ???  what the HELL ???

This guy is a shady snake in the grass and I did not know that people could STEAL like that Legally !!!!  

At this point I'm still willing to pay the entire vet bill and just receive the pup back I do NOT want this guy to have one of our babies !!!!

So there it is....  Have at it,  you will I know....

No CASH or certified cashier's check, no dog, no exceptions.

Echo,

Contact the bank the check was drawn on and ask them what their stop payment policy is. Some only hold a stop payment for 90 to 180 days then the check can be deposited.

Won't get your pup back but will get your the money.
