I couldn't wrap my head around it either. But realistically, if she had sued, she would have gotten zip. Her dog that the pits killed was a little shelter mix with no economic value. My friend wasn't bitten because the pits were so busy tearing her dog apart, so she couldn't sue for bites.

The media give the impression that people sue all the time for frivolous things and win huge amounts of money, but the truth is very different. Most people don't sue, even when they should. How many people do you know who have been really screwed over and didn't sue? Probably quite a few. And most lawsuits don't result in huge judgments. The ones that do get a lot of media attention because they're unusual.

Well, I wasn't thinking about getting big $$....but inconveniencing the life of the Pit owners by forcing them to hire a Lawyer; forcing them to get rid of the Pits, and requesting that they pay all Court costs and for her Lawyer and finally a reasonable amount for her dog.    By her NOT going after the owners, their dogs killed again.    I'm sure that it is easier said than done....but I would have pursued it for sure.

Lawsuits are costly, stressful, and a real pain in the backside.  Assuming you can afford to sue, or you have a good ambulance chaser who will cover all expenses until a judgement is won, then you have the burden of proof..The plaintiff always carries the burden of proof.

I know of a few individuals who have made their lives considerably more comfortable by suing the occasional party...These people I have no respect for at all.  Lawsuits aren't the way to deal with issues...Enforcing the laws already on the books is.

The GSD shouldn't have been loose, that we all agree on.  Whether the woman was hurt as horribly as she says, well, twelve puncture wounds isn't that bad, really.  I've been bitten by a dog, and I've had kids..Nothing came close to labor, unless of course she had an epidural, then it's possible that her bites do hurt worse.  A paper cut would.

Aside from that, I hope she heals fine, and hope the GSD owners don't make the same mistake they did already.  I know of dogs that run at large around here, but none of them "terrorize" the neighbors.  Dogs that are aggressive tend to get dead, because there is no AC department here.. You defend yourself, because there's not much the Sheriff will do.  That tends to lead to what dogs are running loose being a bit nicer.
