Yvette,

As you are looking at doing this as a business, I would talk to a copyright lawyer.   Money well spent. Talk to them about what is covered, what is not.  When is a model release required, contract work (photos for hire and who owns the copyright at that point, owns the negatives, video and digital). 

Take a look at the US gov't copyright link - it is pretty detailed as to what is covered by copyright and what is not.

Just because pictures are posted on a web-site does not automatically equate to public domain and free access.

Thinks about what you need to do with your designs.

As a television professional, I run into this quite a bit.  It is my understanding that the image is "owned" by whoever took the picture and they can basicly do whatever they want with it.  True, most photographers do try to get the model release signed but it is more to cover themselves in case of an issue further down the line than an actual requirement.  The exception to this might be in a case where the subject had a reasonable expectation of privacy.  For example if I see you walking your dog down the street and take a quick snapshot, that picture is mine and I can do whatever I want with it.  If I took a pic through your bedroom window I could be sued for publishing it.

If you took a picture through a window you could be sued, but that is not to say the person would win. Besides, close the curtains!

All this talk of suing over some videos on a website are pretty crazy. Did you see the titles of the videos? Without a specific link to them you would likely NEVER come across them on YouTube. Maybe 1 of 1,000 and I dont know too many people who search for Schutzhund on YouTube anyways. The videos that started this post were poor quality, did not show anyone close up. Just a nice looking sable GSD that did very little to protect his owner. Was it a bad setup? Was it a bad dog? I dont know. Wasnt there, would have to see the boy in person.

But I personally would not care if someone videos my dog and then put it on YouTube or any other site. If you say the video's it did lend and interesting angle to the debate. How can anyone deny what the video showed? You can't. But if you could sue for something like this then why dont criminals sue over the dashboard camera footage of police cars when played in court to help convict them? Think about the criminals who have been put behind bars and the lives saved by using police video to prove a case. Where do you draw the line? This is wrong, but that is right? Who determines that?

I do not advocate what was done, but if Agar knew that she was being videotaped then I dont think it is fair to cry "foul" now. I saw the video, and in no way could I have used that to "hunt her down" if I were an attacker. It simply proved that under those circumstances, on that day, her dog did not perform the task he was asked to do. And for the record, I think he is beautiful and clearly an awesome sch dog, but based on what I saw, no way would I rely on that dog to save my life. Deterrent yes, life saver when the chips are down, no. Buy a gun, learn how to use it. That is the best way to be "protected" from real, life threatening harm. Because even though it is rarely mentioned, my dog, as good a protection dog as he is, cannot stop bullets, doesnt wear a bullet proof vest around the house, and is made of flesh and blood. He can be hurt, disabled, and/or killed and if I have no backup then I am not very smart. That is why we have the right to own and bear arms! I also believe God watches over his children........

Flip-  I need to clear something up here real quick for a few people...I wasn't the one making a big deal about the videos being posted-really I could have cared less had it not been done with alterior malicious intent.  Had it been for a positive constructive reason then I'm sure whoever was intending to post a video of their friend, club member, buddys gramma's dog whatever, they would have at least said "hey, I'm gonna post that picture or video of you".  I didn't cry foul over it, I never mentioned anything whatsoever about suing anyone by god I'd get more money out of my 10 years olds piggy bank.  I don't need to sue anyone especially over some petty ass shit that was purely kid stuff-I work for a living and I do very very well for myself.  People that are sue happy are lazy and broke lookin' for a free ride-that's not me! Other people posted their questions and thoughts when they saw what was happening-perhaps out of curiousity of the reprocussions, perhaps for standing up for what was right....whatever the case questions and statements were asked and made BY OTHERS.  I did request the videos be removed because of the way it was done.  Period-that's all it was that's all it is or gonna be.  Please don't try to read into something that isn't there.  Thank you for the compliments on Agar.  To me it doesn't matter who likes him or not-he's mine, I adore him and wish I had 5 more exactly like him. That's the only opinion that really counts at the end of the day cause I didn't buy him to impress anyone else and whatever purpose he serves he will always be a teasured family member in my home.

I understand. You, like me, surely love your dog and that is what matters. I am not sure who added this whole thing to my original post but it sure got out of hand fast. Guess when hundreds of people look at something your bound to have crossed wires. I should have started another post about my protection dog comments, thought I think I make some good points about how much faith you should put in a dog. At the end of the day I would never 100% trust a dog to save my life, I do trust Jesus 100% though, He always has my back.

Ok, I'm out. I have a male I need to concentrate on selling.....

OMG!  What timing!  I can't believe this... someone is using MY pictures to sell their puppies!

I logged on the PDB this morning and lo and behold I see one of my pictures that I took at our club's seminar last year being used in an ad here on the PDB. 

She's posted a classfied ad using my picture - soliciting training services.

She posted a classified ad for a "working" litter and following the link to her web site I find MY pictures used to adverstise her female's puppies.

If you go to her website, those are MY pictures of her female doing rag work at the seminar.  I sent her an email off-line asking her to pull the pictures, or talk to me about Permission.  I don't care if she shares the pictures with friends and family for personal use, but Commercial use is another matter.

I hope we can resolve this quickly!

So, from the outsiders view, you had a very good opportunity to have an honest discussion about what most dogs are, and then it has evolved into who has the legal right to show video. WOW.

If I ever train with you, and you take film of me doing well, or completely fucking up, please feel free to use it. It is better to see things for what they really are instead of making excuses. Or if you are making excuses, at least be amusing.

Sad. Our breeds are so doomed. All hope is lost, and I am not kidding.

Sorry Jeff, I don't buy that the breed is doomed, not as ling as people love them as passionately as they do.  I really liked the thread about "What makes your dog special"  Perfect example of what I am saying.

Just  FYI - Baby Eagle is wrong on many of his/her answers. Don't have time today to go down the list but if you truly need answers go out and  look up intellectual property or speak to an IP attorney.

SchH Babe you need to contact the website and tell them to cease and desist. You also need to immediately contact their ISP> This is a violation of most ISP terms of service and you can demand the website be taken down because of that ( problem is it persists thru cacheing and other things. If the website does not clearly id the person and their address I would demand this from the ISP as well.

Contact the BBB and Chanber of Commerce in this person's location and lodge a complaint. Send a copy to the local DA's office.

Finally before doing these things save a copy of the offending pages to you hard drive and make a print copy if you can.
