For someone with as many dogs as you have I would think this happens a lot.

3 deposits.

I looked at what there was of a website and your dogs, and some prices.

1+1=9

Give the money back and stop breeding.

Agreeing to sell three puppies to anyone is nuts, imo. Therapy work sounds weird, who has three therapy dogs at once, unless she means service work? Even so, most trainers who raise dogs for service choose pups themselves for the right qualities, not sight unseen over the internet.

If she actually signed something agreeing that the deposits were transferable only, not refundable, she likely can't win, especially across state lines. Who gets a lawyer for $600 anyway? It's likely just a threat.

However, the terms did keep changing. I'd give her back the money and wash your hands of her. Vickie and Robin are completely right.

For some reason my original thread is gone.   I have NEVER had to deal with a refund on a deposit before.   I don't care about refunding and actually this all came about last night.  Not even 24 hours had passed since the breeding change.  The fact is why is there such a thing a  non refundable deposit if it doesn't even matter.  It's not a case of refunding its a case of why put it in writing at all if no one respects it.

What the OP copied in her first letter was that the buyer was going to sue for the price of the deposits plus any atterney fees. The problem here lies with the fact that this is going to be a civil case of under $5000 which is the max limit for such small cases. It would be a huge waste of her time to try to recover, and its her choice to come out of pocket in atterney fees and plane tickets etc. It does not become your responciblity just because she is demading this money within 3 days.. too bad!! 

Buyers remorse does NOT include refunds of any deposits, and if you told her she was getting a refund its YOUR kindness and on YOUR time limit.. Especialy when you have to sell the DOGS she tied up sales for !! She KEEP you from being able to place those dogs by putting a deposit on them, when they sell - or at least one of them- then give her the money.

 I think you will soon realize that sometimes it would be best if you not ask for advice on a public forum.. There are way too many people who give opinions and firmly believe that their opinion is the only correct solution. Than if you don't agree with them, the script is flipped...and the topic is redirected and it won't have nothing to do with YOUR original topic question..

Why don't you just do what YOU think is best.. NO ONE can tell you what is best for YOU or YOUR situation.. This way, regardless of the results, you have no one to blame but yourself..

Again....simply stated....NON refundable... means...NON refundable.
The people involved should be the ones to decide "what terms they are willing to accept or not".....but "sanity & closure" reaps the best benefits!

I am to assume you don't want to or maybe can't refund the money till you sell her pup because you used the deposits?  If that IS NOT the case just cut your losses and refund her the money ASAP.  If she has bought several dogs from you before then why throw away this business relationship?  If you don't care then refund her if you want and when you want.

She paid deposits in Feb.  and since they are non refundable I had used it after a breeding took place that she had reserved knowing that I would have pups.  She cancelled that reservation after breeding took place and I do have pups on the ground right now from the original reservation.  The last few weeks we had some new stuff come up and people can think badly if they want but we got in a financial spot because of some unforseen issues.  I can refund her when this litter leaves in 4 weeks.  I don't mind doing that.  She has NEVER bought a pup before from me she has ONLY reserved and then changed her mind and reserved others and it is very clear that the deposits are non refundable and agreed upon in the receipt as well.  I don't care what she thinks of me as I have moved her from litter to litter since this started about 6 times.  She is a flake.  Now she is demanding it in 3 days and I just don't have it in 3 days thats all.

Easy, then tell her TOO BAD, don't give her a dime if she isn't willing to wait till a puppy is sold!  Easy peasy!

NO NO   I wasn't insulted by you  I have just had a few people pm me from this and say that I was a bad breeder for spending a non-refundable deposit and to quit now.  I just think that it is her problem and not mine when she gives a deposit and understands what the specifications are.    THANKS SO MUCH for you views though  it really does help.  I just didn't know if she had any leg to stand on with the 3 days thing.
