WDA has the backing of the WUSV ..........
UScA is pissing the WUSV off

I'm wondering who is really done in the long run.........

Really, the WDA doesn't have anything unless the GSDCA is involved in it. You think a few hundred members are going to take over representation of the GSD in this country?  The GSDCA is the WUSV member.

From the IRS:

Exempt Purposes - Internal Revenue Code Section 501(c)(3)

"The exempt purposes set forth in section 501(c)(3) are charitable, religious, educational, scientific, literary, testing for public safety, fostering national or international amateur sports competition, and preventing cruelty to children or animals. The term charitable is used in its generally accepted legal sense and includes relief of the poor, the distressed, or the underprivileged; advancement of religion; advancement of education or science; erecting or maintaining public buildings, monuments, or works; lessening the burdens of government; lessening neighborhood tensions; eliminating prejudice and discrimination; defending human and civil rights secured by law; and combating community deterioration and juvenile delinquency"

Exempt purposes - Code section 501(c)(7)

A social club must be organized for pleasure, recreation, and other similar purposes. A club will not be recognized as tax exempt if its charter, by laws, or other governing instrument, or any written policy statement provides for discrimination against any person based on race, color, or religion. A club may, however, in good faith limit its membership to members of a particular religion in order to further the teachings or principles of that religion and not to exclude individuals of a particular race or color.

Whether an organization's purposes are consistent with exemption under section 501(c)(7) is generally determined based on its organizing documents.

This has occurred already in Japan.  The traditional WUSV member was the JSV whose membership is 1,500.  They were members of the WUSV since 1974.  All the rights of this organization was transferred to the new 50 member WUSV club SVJ.

The letter from the President of the JSV outlining the situation and their removal from the WUSV can be found at this link:

From what I have read,  Mr. Yamada is behind the new SVJ and all approvals for judges etc. must go through the 50 member organization.  There is more on Jantie's site regarding the interpersonal relationships of Mr. Henke, Mr. Lux and Mr. Yamada and that Atos Agrigento just went VA1 at the Japanese Siegershow and owned by Mr. Yamada.

I believe both the USCA and the GSDCA have much more in common as a result of the recent events than one would think.

So sadly, Schznd, I question your assumption.

@Mystere, why are you continuing to discuss the differences between a 501(c)3 and 501(c)7?  Its clear that both USCA and the WDA are 501(c)7 organizations.

What I pointed out was that WDA noted on thier 990 form, as REQUIRED BY LAW, that they DID in fact accept over $100,000 in non-taxable donations from members, other sources, etc.  WDA also stated that they used the labor of roughy 150 volunteers on thier 990 form, as REQUIRED BY LAW.

In contrast USCA, the larger organization, both in terms of revenue and "number of fee paying, non-voting, members", claimed on thier 990 form that THEY DID NOT accept donations totaling over $100,000, during the course of the year.  Second they also stated on thier 990 form that they had NO VOLUNTEERS that year either.

I personally feel that such would be an IMPOSSIBLE claim for USCA to make due to thier size.  Meaning they certainly used volunteer labor at some point and they certainly have recieved both free things & donated money to run trials, etc.  HOWEVER, they did not report information on thier 990 reflecting such.  Thats thier right to do so, but I have a very difficult time believing that claim.

If UScA and WDA have something in the by-laws about educating their members and the public, would that fit the requirements of 501(c)3?

Also by educating people on husbandry, training and handling, wouldn't that also lesson burdens of government (Animal Welfare Act)?

Any accountants out that that can answer this?

@Sitasmon, yes it would, but I don't think either is interested in changing into a 501(c)3.  There are less documentation and accounting requirements for a 501(c)7.

Also for a good laugh, here is USCA mission on file with the IRS, its literally one sentence.  If they went 501(c)3 they'd have to make it a bit longer and more detailed:

TO PRESERVE THE GERMAN SHEPHERD DOG AS A WORKING DOG

Here is WDA's:

THE GERMAN SHEPHERD DOG CLUB OF AMERICA-WORKING DOG ASSOCIATION, INC (GSDCA-WDA) WORKS TO ENCOURAGE AND PROMOTE TRAINING OF THE HIGHEST QUALITY PUREBRED GERMAN SHEPHERD DOGS (GSD), TO PROTECT AND ADVANCE THE INTERESTS OFTHE GSD BREED BY ENCOURAGING SPORTSMANLIKE COMPETITION AT WORKING DOG SPORT TRIALS, TO DEMONSTRATE THE CONSPICUOUS ABILITY OF THE GSD IN ITS ROLE WITH THE MILITARY, RED CROSS, POLICE, DRUG AND EXPLOSIVE DETECTION WORK, SECURITY WORK, HERDING, SEARCH AND RESCUE WORK, GUIDE DOGS FOR THE BLIND AND DEAF AND AS A COMPANION, TO ORGANIZE WORKING DOG SPORT TRIALS ACCORDING TO THE RULES OFTHE VERBAND FUER DAS DEUTSCHE HUNDEWESEN OR SUCH OTHER ORGANIZATION, TO PUBLISH OR AID IN THE PUBLISHING OF LITERATURE, PERIODICALS AND OTHER EDUCATIONAL MATERIALS IN THE INTEREST OF THE GSD AND THE WORKING DOG SPORT, AND TO ADOPT RULES AND REGULATIONS CONCERNING THE OPERATION OF BREED/CONFORMATION SHOWS, TRAINING SEMINARS AND THE APPOINTMENT AND QUALIFICATION OF APPROPRIATE JUDGES

The WUSV runs the show for both the WDA and the USCA.  The WUSV can have 10 member clubs in the USA or none if they want to and if the WUSV membership clubs approve it (and they will if the WUSV and the SV wants it).  The WUSV plays with the GSDCA-WDA and the USCA like a cat with a mouse and a small mouse at that.  The GSDCA is more problematic in that their business really does not depend on the WUSV or the SV registry.  The fact that the GSDCA spent a ton of money on the WUSV World Championship in 2013 is even more puzzling as the GSDCA does not need the SV or WUSV to survive and prosper.  What the hell were they thinking???  The USCA and the WDA however would be nothing without the WUSV and even the AWDF might get a cold shoulder from the FCI if the SV and WUSV decided to pull the plug on the USCA.  I have no doubt the WUSV will continue to collect money from the WDA and the USCA because it is in their business interest to foster the import of European GSD and the SV registration and pedigrees from those dogs, their offspring, and other dogs bred by USCA and the WDA adding money to the SV income.  The USCA breed registry won't exist without the SV and the AKC already is the FCI peace treaty holder for cross recognition in the USA so forget FCI recognition if the SV does not put their stamp on the USCA breed registry.  The AKC now must cross register with all SV and USCA or the FCI won't touch them as the AKC is the prize the FCI is after in the USA and a big prize it is.  Neither the USCA or the WDA can get FCI recognition without the AKC and or both the AKC and the SV.

"The USCA and the WDA however would be nothing without the WUSV "  The only thing the WUSV offers is 1 trial that effects 6 people...... other than that they don't control crap.

  Momo

Could be sentences like this in your nasty posts : "   I also DO SAY they are a 501(c)3 and not a 501(c)7, don't know why you can't seem to read & comprehend what I wrote."   (  ( Emphasis added)    See?  I read and comprehend quite well.  Perhaps it is the misstatements of the writer that is an issue?  Regular Smile
