I can't get on the breeder's side, either. Defending yourself by claiming all the rest of the pups are fine is lame. When I called the breeder to inform him that my dog had been diagnosed with severe hip dysplasia he literally screamed into the phone that all the rest of the pups were fine and I must not have given the dog proper nutrition. Then the phone was slammed in my ear.

For anyone who wants the evidence I have current photos of this puppy and xray and medical statements  as well as this breeders emails. I work in Law Enforcement and I am completely appalled at this type of breeding.  I have a wonderful female dog from Vom Holtzberg, she is 2 and the transaction was smooth.  So I do know there are good breeders out there, this one took me by suprise because it was supposed to have law enforcement association

thanks for your comment.  I would love an appology, .  This little guy deserves one, the heartache we are going through preparing to put him down this weekend is sickening.  He is a sweatheart and you can see that he doesnt understand what is going on with his legs, his mouth. We tried everything we could, but the elbow is so bad that the Ortho specialist said he was not even a candidate for total hip replacement.

thanks-  I have filed with AKC both the registration area and the investigation.  Also the texas SPCA for that area ( animal cruelty) I have law enforcement contacts in texas that I have contacted as well.  I filed a Texas BBB, but I never heard of the lemon law on puppies.  I will reserach tonite.  Thank You.  yes I have kept all the medical bills and eval and I have scanned the xrays to keep for later.  thanks again

You will be contacted by your local SPCA, BBB and AKC.  I have provided all the medical documentation.  The SPCA has told me that the documentation is sufficient evidence of cruelty, I have video and photos along with dr's reports in this case.   Come on down to California, I would love to see you face to face and stand up for this puppy that you doomed from day one.  You should not be allowed to breed.  We have done everything we can for this dog and you could care less.  This is all about money to you.  You knew on the  8 week vet visit this dog had problems before you sent him to us.  You have no excuse and should appologize first and foremost, and second stand up and be and adult and take responsiblity for this litter.  You knew there was a chance for genetic defects with the pedigree makeup and yet you prey on people who dont have the training to read pedigrees.  I trusted the fact that you CLAIM law enforcement work, and being in law enforcement myself , felt that you could be trusted. I hope you can live with yourself with all that you have put this little guy through. We have loved and provided for this little guy from day one.  I will continue to fight for the dog and file any and all claims to keep you from putting another buyer from this again. This pup will be put down soon and you will receive all documentation, as well as the SPCA before he ever got to be 1 year.  Shame on you!

You made no offers.  You were sent his medical diagnosis, you know the truth about this puppy.  Shame on you.

Okay.  I read both sides presented herewith (legal talk ya'll), and I understand both arguments.  Apparently the sticking point is this:  Buyer wants the money back and wants to keep the dog, or buyer wants a refund and more money for the expenses put out to help the dog and wants to keep the dog, or buyer wants a refund and more money for the expenses put out to help the dog and wants to keep the dog and wants a pound of flesh.  Buyer:  which one of these is correct?

On the other hand:  Seller wants the dog back and will give a refund, or seller wants the dog back and will give a replacement, or seller wants to give a partial refund if the buyer wants to keep the dog.  Seller:  May I ask which of these best describes what you would like to do in connection with this situation?

Only comments I have are that IF the buyer returns the dog, then it belongs to the seller again, to do with as she wishes, in accordance with humane laws and buyer has no say so in the matter.  It is unfortunate for the dog to be a "tug toy" and be suffering besides.  An argument could be made he is unaware, however, he has changed homes once already and will maybe have to be uprooted again.  IF (there is that word again), I was the breeder, I would verify the expenses claimed by the buyer and if they are so, I would let her keep the dog and refund her purchase price.  But that's just me.  I'm just saying.

are you asking me?  The vet will not sign a health certificate for this pup to fly. This breeder knows this. I just wanted to get the word out on this case , and see if any of the other buyers from this litter would respond. I also wanted some advise since this has been a horrible experience.  I also wanted to stand up  for this little guy and hope that she does not breed this female again, so no one else will ever have to go through this experience

She has gotten the scanned copies of the medical ailments of this dog, and saw the last reccomendation was for the pup to be put down.
