Both the pups dont pass muster...

Neither pups would be my choice for a future show dog either. Perhaps you should wait and learn more about structure before trying to pick a puppy for show purposes. Get an adult that is already a proven winner if you really want a show dog now.
Any breeder that says a puppy will absolutely be a winning dog is spouting salesman BS. If he promises that a specific judge will put the dog up in a high placing then perhaps that judge (and the breeder) is crooked.

he is not going for Show, Just a puppy of GSD, but with no problems what so ever.
Well, my opinion to you especially if you dont like to compete, just get a nice healthy puppy and enjoy, with the time you will also learn on whats good or not. There is a lot of very nice puppies which is not in top 30's but are still good, healthy Pupies.
peace
