I was led to understand that certain Championship Breed Clubs who also held Obedience CC status (after my email informing them that this KC Undertaking appertained to Breed CC;s only and couldnt effect Obedience CC;s on the grounds they are 1) Not Breed Specific, 2) Ob judges do not assess soundness and 3) Double Handling does not apply), were going to write to the KC to ask them to confirm that their Ob CC;s would not be effected, so that they had all the necessary information to hand prior to holding their AGM's. 
If I remember correctly, the AGM of one of these Clubs is to be held this week and therefore it would be interesting to know if the club has recieved an EXPLICIT reply from the KC in time for their AGM?  Failure to reply to such a pertinant enquiry would be Gross Negligence on the part of the KC as would ANY reply which did not explicitly answere the question directly. 
Such excuses as the General Committee would not be meeting to discuss this until after the 31st March 2010 (the date given for Clubs to have returned these undertakings) is inexcusable and such a declaration would be deemed UNREASONABLE and therefore viewed an unacceptable excuse in a court of law.
THE MORE THE KENNEL CLUB TRY TO INTIMIDATE CLUBS INTO BOWING DOWN TO THEIR BIDDING, THE BIGGER THE HOLE THE KC ARE DIGGING FOR THEMSELVES, AND MOREOVER THEY KNOW IT!!!

Hi Sue,

You m be referring to B`ham & Dist.    We have written to the KC for clarification on that point, and asked for a reply by 20th Feb which is our AGM.   Our Lichfield AGM is 10th Feb but that is only a branch one, so I will let everyone know what the reply is as it comes in from the KC   (or doesnt come ion from the KC as may be the case)     Mo

The first part in italics is the last part of the letter from the KC.

The Committee confirmed that this event should continue to receive Kennel Club Support with the condition that the team organising the event must be led by clubs which have signed and returned the recently issued Undertaking relating to the allocation of Championship Status 2012 and beyond. The Working Group is also reminded of the conditions attached to the Kennel Club's support of this event as notified in previous correspondence.

I wish you well with the organisation of this competition and if I can be of any further assistance please do not hesitate to contact me.

The above is along the same lines as everything else you are doing to the conscientious German Shepherd breeders in the UK, blackmail. If you only knew what the rest of the world thought about the UK Kennel Club, you would like the ground to open up and swallow you.

It's most apparent nobody on the Board of Directors know anything about German Shepherds and are not prepared to listen to the dedicated enthusiasts of the British Isles, who are striving so hard for soundness in both mind and body, as we are here in Australia. Is your lack of understanding more to the fact that this is a German breed, does your Board of Directors consist of persons who still hold a 70 year grudge? Why do you not listen to what the knowledgeable breeders of GSDs in the UK are telling you, they HAVE the understanding of their chosen breed.

If anybody needed a reason not to sign surely the KC's actions and threats are sufficient.

IMO even if the agreement is signed it could be argued that this was done under duress

What Is Duress?
Duress occurs when a person is influenced to sign a contract under pressure.
Typical examples of duress include threats to personal liberty, threats of actual violence, and excessive economic pressure.
 If you sign a contract under duress, the court may find the entire contract invalid.

Duress and Contracts
Duress occurs when a person has been forced to do something by means of a threat. A person may raise a duress defense when force or violence is used to compel him to enter into a contract or to discharge one. When a person raises a duress defense, the accused asserts that the contract should be invalid because he did not voluntarily enter into the contract.
A person who enters into a contract under duress may cancel or breach that contract


The letter from the KC is based on their threat of the withdrawl of CC's.

HI Mo,
Oops my apologies for the delay, Yes I was !! Sorry Mo but had completely missed your reply to me here until this thread was revived again today by Skippy and Pacosbear. The fact you are still awaiting a reply from the Kennel Club to such an important and pertinant question for your club at this time should be cause for amazement, sadly , as you, I and other enlightened people now know, it is only what we have all come to expect from them, it's the KC's  'Par for the course'. 
Reveal nothing that might undermine their previous intimidating tactics before the deadline passes on 31st March, or in other words, they know they would be foolish to issue more threats and punitive action at this time as they are at last starting to learn not to dig themselves into a bigger hole than they have already created.

Anyway thanks Mo, dont forget to keep us posted. Of the many things I have noticed recently, each one of our actions creates a positive reaction from the KC, to put it another way, we mention something here and the KC respond to it via a latest Press Release or letter such as giving us their permission to run a British Sieger this year, which NEWSFLASH  which we dont need by the way (their permission that is!!)
