Let's review:

1. Buyer initially claimed ""Breeder refused refund or return of pup for another."  Breeder subsequently posted multiple email communications tending to show otherwise.

2. Buyer claims pup is defective in multiple ways, but a) has yet to provide any access to photos of the pup despite several requests to do so, and b) sent emails with alleged pictures of the radiographs of the pup's hips and elbows that do not contain any specific reference to the pup himself and could have been simply copied from any of hundreds of web pages.

3. Buyer then claims that WonderVet just yesterday diagnosed serious cardiac issue in pup, who is rather conveniently now at death's door.

4. Breeder tries to contact WonderVet, who refuses to discuss pup with her - so obviously Buyer did not authorize WonderVet to discuss the pup's health with Breeder, which makes no sense at all if the pup's health is at issue.

5. Buyer claims to have contacted everyone under the sun to complain about Breeder before posting here, and continues to threaten Breeder.

6. Notwithstanding that contract between Breeder and Buyer required return of pup in order to receive a refund, Buyer refuses to abide by this term.

Conclusions:

1. There is absolutely zero hard proof that there is anything wrong with this pup, only Buyer's allegations of defects.

2. There is substantial evidence that Breeder was at all times willing to honor the contract warranty and refund Buyer's money upon return of the pup.

3. There is substantial eveidence that Buyer breached the duty of good faith and fair dealing implied in any contract for goods or services, first by refusing to accept the previously agreed-upon contract remedy offered to her by Breeder, and then by libeling Breeder on this messageboard and apparently slandering Breeder to numerous third parties.

Sorry I didn't come here to humor anybody.. If I decided breed to Zambi.. I highly doubt that shes going to produce 11 puppies.. maybe close to 5. Since you asked this question in a hypothetical way, I'm going to treat it hypothetically :) Would I keep all 11 puppies?? No and even if I choose too.. the city would be up my ass about it.. If I do see a highly potential pup (or more) then yes I will keep it back for more evaluation and to possibly find a Co ownership for future career for the pup(s). If for any reason I sell somebody a puppy who the puppy developed HD/ED or developed genetic deformations.. Obviously I want proof. I would expect to have at least 2 different vets professional opinions (I expect the vets to know about the breed) and would want their signature on the bottom. If it's HD/ED.. I would require them to send the Xrays to OFA and actually have it certified (or looked at if the dog is under 2 years of age) and feel confident that it was viewed by a certified radiologist specialist. Once I have evidence of proof that the pups condition is caused by genetics then I would refund the buyers money and allow them to keep the dog if they choose to. The motive is to make sure that the buyer is HAPPY and SATIFIED regards to what happens. If they choose to return the puppy, I would gratefully accept it and would wait at the airport for the pups flight to arrive.

I would not spay Zambi because of that one puppy, which is the reason why I'm asking Malinda why shes planning on spying her bitch.

I don't know Mailnda, never met her a day in my life, I've come to my conclusions based on whats been posted here. And I will say a second time, I would love to see some time stamped photos of this deathly ill puppy posted here. Again, if I bought a puppy that sick, I would damn well WANT my vet to speak to the breeder.

AZshep hit the nail on the head, along with several others. If you don't like the terms of a contract, you dont sign it and you dont buy the dog. Period.

Every breeder knows you can breed the best to the best and unfortunate, unpredictable things can happen. As a late breeder I always looked up to once said, "Your contract should be the absolute minimum you are willing to do for your most disagreeable buyer".  I think this breeder is doing exactly that and more.

 

And I notice the OP has disappeared since the folks here have pointed out her story has more holes than swiss cheese.

Here's just my 2 cents worth.........

Being a breeder & buyer MYSELF........a contract is a contract period.

BEFORE you sign ANY contract,....read it!!     If there are specifications that you do not agree on,..that is the time to "re-negotiate" the contract.

Personally,...WE do not require ANY puppy back for the "replacement" guarantee to be honored....but that is our (choice).

There will always be un -happy buyers, and a "jury" ready to crucify the breeder........just as there are as many wonderful buyers that have been "violated" by unethical breeders......

Just found this strange and rather long debate. 

I am in law enforcement in the San Jose area.  After reading this never ending trilogy i requested the x-ray from this buyer.  She sent this almost immediately and I read the name on the email and found I know the owners, they are both in law enforcement in this area and both very good people.  The breeder is aware that they are both in law enforcement and very easy to contact.  I know about this dog first hand because these 2 have taken it for training at Witmer Tyson fields where I am training my new male pup.  The huband (who is a high ranking officer) was talking to us about the problems he had with the dog and the breeder.  Now I don't know didely about the medical aspect but what I do know is that  this dog is very odd looking, and it is obvious that there are health issues,the trainer spoke to the couple several times about where they got the dog, she mentioned there was a real problem with the front elbows and back hips.  I asked them tonite about a contract, guess what the breeder failed to tell everyone here there was no contract, there was an invoice with the dogs name and litter number and that was it.

So the moral to this story is listen read and even enjoy but do not get involved in a buyer/breeder issue.  It will never be clear to anyone. 

My only concern and advise here was that this is a law enforcement couple, for NOOB and everyone else thinking to drive and basically steal, rob ,harrass .the dog and this couple you would be commiting a crime ( there is no contract therefore no property rights) and second making a fool of yourself because this clever breeder has not told the facts, the facts are these are great dog owners, going to extreme on this line bred dog who has obvoius problems. 

Im going back to finding more information on fixing my male.  Good Luck and remember in all cases unless you are directly involved, you dont know all the facts and unless you do, stay out.

People, read the puppy owner’s second post (five posts from the top of this thread), and I quote, verbatim, from the owner of this (supposedly) dying puppy: “we are looking for another puppy but have no idea where to look for a german shepherd so that we do not have to go through this again.” Why is the owner of the puppy viciously bashing the breeder’s reputation repeatedly, not focusing on a reasonable solution to this situation, especially for the (supposedly) suffering puppy’s sake? Yet one of the first things the puppy owner states on this more-or-less anonymous internet chat forum is that she and her husband intend to go out and PURCHASE ANOTHER PUPPY?????? And they need strangers' help doing that!!!!!!! Oooohhh, but first, got to convince the strangers of the victimization of the puppy and the puppy owner by the horrid breeder!!!!! When she has stated her current puppy is in such bad shape, giving a laundry list of ailments, she's aiming to PURCHASE ANOTHER PUPPY???? When she has asked for sympathy for the (supposedly) sick puppy, we WHO LOVE GSDs WITH ALL OUR HEART and would of course give sympathy to a sick puppy, are supposed to give her advice about PURCHASING ANOTHER PUPPY???????? Hmmm….all those (supposed) vet bills, all that (supposed) round-the-clock care, emotional pain and grieving of an allegedly sick and/or dying puppy…and she somehow finds time, money, determination and energy (but by her own admission, lacks knowledge on how to go about doing so) to contemplate that she wants to now PURCHASE ANOTHER PUPPY????? Then she states, hours later, when the list starts wising up and not uniformly rallying behind her story, that this puppy is supposedly dying? Oooohhh, now I believe her!!!!!!! Let's all help her PURCHASE ANOTHER PUPPY!!!! Sorry. Couldn't avoid the sarcasm here. To the puppy owner, if you're reading this, if you don't wish to give the dog back to the breeder, get a second opinion on diagnosis and available treatment from a more qualified vet. Have your medical records forwarded to the second vet, and don't go back to the first one. If the puppy is in need of being put to sleep, calm down, call the breeder, and let the breeder know what the second opinion is, and go from there. Put aside all this bashing and do the right thing by the puppy. If you are on the up and up -- and I'm doubting that -- wait at least one year before adopting another puppy. Quit blaming others. Take responsibility for decisions you're making. Learn as much as you can before shopping for a puppy. That means at least one year of reading reliable experts on various topics relating to a serious, lifetime commitment to a large-breed working dog. No looking at puppies, dams/sires, pictures of puppies, asking about litters, whining about what happened last time. Sit down and read and learn. If you are not on the up and up as far as this -- you don't deserve a GSD. Get an ant farm. I myself am not cut out to be a breeder. Love the dogs. It’s the people I find hard to deal with. A quote by Kinky Friedman, proprietor of Utopia Rescue Ranch for Dogs: “There are no bad dogs. And there are no good people.” I am a search and rescue dog handler, and I own one of the best tracking dogs in North America, a six-year-old GSD bred by Malinda Julien, given to us as a gift by this honest, brave, kind-hearted soul. Malinda does not deserve the treatment she has received from this puppy owner. However, I’m trying to keep my focus on the puppy’s welfare, because having read all the posts here, and knowing Malinda, she is able to take care of herself. Adrienne

I've been doing a LOT of research on my bitches background! I know how many times my bitches mother been bred and I know how many she produces! Don't sit here and say it's ridiculous because it's indeed a FACT!
