reinrider, I also suggest that you contact the Miniature Bull Terrier Club of America and lodge a complaint, since on their website--which VERY CONSPICUOSLY shouts that THEY! BREED! MINIATURE! BULL! TERRIERS!-- these breeders claim to, and I quote:
"agree to abide by the rules and regulations of the Miniature Bull Terrier Club Of America, and do also agree to conduct our activities with regards to MBT as suggested by the breeders Code of Ethics we so truly believe and live by."
That's directly from their website, after all--and I would also suggest you print out a copy of every page, since NOWHERE on their site do they make any mention at all that the dogs they are selling are registered with the AKC as Bull Terriers, NOT Miniature Bull Terriers. Despite their website claim that 'All our advertising is factual.'
Out of curiosity, reinrider, is your pup smaller than the standard for the Bull Terrier, despite being outside of the standard for the Miniature Bull Terriers? I'm just curious as to whether the game here for this breeder has been along the same lines as breeders who tout their 'teacup' poodles and yorkies and other toy breeds, when basically all they are doing is breeding grossly undersized specimens of an established AKC toy breed... The difference here, of course, is that there actually IS an AKC-recognized breed called the Miniature Bull Terrier, and there IS a parent club for the breed, unlike the 'teacup' versions of the toy breeds.
Personally, I'd have to seriously consider taking these people to small claims court over this--because no two ways about it, they have defrauded you, and are still at this moment claiming to breed and sell Miniature Bull Terriers, both on their web site as well as in their kennel listing here on PDB...and wherever else they're advertising their dogs. It's not right for them to expect you to return the dog now that you've become attached to the animal, and while you would very likely pay the same amount of money for a good Bull Terrier puppy that you paid for what you were told was a Miniature Bull Terrier, there should be some punitive action taken against this breeder, some sort of punishment for their deceptive practices and advertising. Small claims doesn't require an attorney, and the filing fee is generally modest--and if the breeders lose the case [I can't see how they wouldn't], they have to pay your court costs in addition to any monetary awards, fines and so forth.
Good luck with this...if they've been breeding these dogs for 8 years, it's about damn time somebody called them out on their fraudulent activities!

Per my earlier post, I have spoken to the officials at MBTCA who confirmed that they never have been members.
Our puppy is 38 pounds and 17 inches at 11 months. So yes, she is small for a standard bull terrier and obviously too large for a mini. In my opinion, they have bred small standards, possibly mixing minis and standards. And, because a mini commands more money, I believe they sold them as minis hoping that they would not exceed the mini standards and that no one would challenge them.
She claimed she is selling or adopting out all the dogs that are standard Bull Terriers and not selling them as minis anymore but where is the proof? The puppies they have for sale look so much like her I had to zoom in to check the markings on the nose to make sure it wasn't a picture of our puppy.
They have also changed their name in the last few months from Lowrider Bullies Kennel to King Kennels of Florida.
And yes, we are taking legal action for her full purchase price and any costs incurred in filing a legal claim.

You may find that going thru the courts you may win the case, but if your looking for more than half the purchase price refunded, then the courts may want you to return the dog to the breeder. In the end one or both parties will end paying. The breeder will change the name of the kennel again and keep doing what they have done in the past.

However, misrepresenting the breed of a dog sold is a first degree misdemeanor in Florida. If we file a complaint with Florida Attorney General and Consumer Services as well as the AKC, it will cost them a lot more than refunding half the purchase price. They would have to convince the court that they didn't know what they were doing.

maucg.......I'm glad I could help. I have since talked to the officials of the South Dade Kennel Club, which they claim to be members of, and confirmed that they are not. Also, if you go on offa.org to see if any of their dogs are checked for health problems, none of them are on there.
AKC, the Miniature Bull Terrier Club, the Office of the Attorney General of Florida and the Department of Agriculture, Division of Consumer Services have been notified and provided with the documents that I have.
Today I see their website is not up but their facebook page still is as well as their ads on puppyfind.com. I am hoping the authorities have started working on this case and they won't do this to anyone else.

reinrider hopefully the situation will be resolved favorably.
I would like my future litter stay with people who love them and treat them as family members like you.
