Thanks for everyone's advise. I got my deposit back. Whew ....lesson learned. Time to start over and look for another dog. What a big dissapointment. I get now what the poor person is going through that sent the Czech dog in whelp to AZ without payment. Although my meezly deposit is no way in comparrison to what they have into their dog, I understand. Glad the breeder agreed with everyone here.

That's a great update, BHaugh...sounds like the breeder understands the term 'ethical'. It speaks well of her, whoever she is. [I'm presuming that you didn't post this update prior to actually HAVING your deposit back, because agreeing to refund and actually following through with it does seem to pose an obstacle for less ethical individuals I've observed...]

The same happened to me, I called to see if the pups were born and was told the female didn't take. I never received an email or a call. Breeder moved the deposit to the 2nd dog I called again when due and was told she miscarried...THIRD time, same we put the deposit on another dog when the pups were due I emailed and was told two pups were born and both died. At no time did the breeder keep us up to date. So the 4th dog I told him we did NOT want as I didn't like the female she did have pups and he tried to get us to take one. I said I dont want one of those pups, I said we had 3 deposits on technically 4 dogs...The first deposit could have been on one of two dogs we didnt care which....however not one pup...so he complained and said I dont return deposits but I will. I was so ticked..this breeder is in Ohio..Hope yours is not... good luck :)

It is very possible that the female had a false pregnancy, or was pregnant and absorbed the litter. It just happened to my co-worker's Golden Retriever, the vet said she was pregnant via palpation, she gained a ton of weight, milked up, took an x-ray and there were no puppies.

Good for you Baugh and the breeder. I have yet to put a deposit on a puppy, and I have managed to usually come up with what I want. I came close on a nice w/l litter (female bred in Germany and shipped to the U.S.). No way the litter would be repeated if something went wrong. I stated up front that I was only intrested in this litter and not willing to transfer deposit for anything else. They were offended but better that than me having to accept an animal of lesser quality and an unknown waiting period.
I look at it like my money is worth exactly what the animal is worth and I have my own policies regarding parting with it. The main one being that if I make a deposit, it is non transferable and refundable if an error is the fault of the breeder.

We do not take deposits until after the litter is on the ground. We do take names though....the litter we have now only consists of four pups, there were six pups but 2 were stillborn, we had a list of ten people cause the bitch looked big and was as all the pups were big, so as it stands we have 4 healthy pups. If we had taken deposits before pups came, we would have felt obligated to return them as that's what we do..........Very glad to see you got your deposit back!

Reminds me of the stud I used years ago, was assured he was producing well at 8 years old, my prog tested bitch missed twice before the owner admitted the stud had a problem, a 3rd mating produced nothing at which point the abuse came my way. was I unreasonable asking for a refund when the stud had produced nothing to other bitches during this time and my bitch conceived first time to another stud ?.

Glad you got your deposit back. I take names on a list until the dog is ultrasounded at around 30 days pregnancy, if confirmed I will take a limited number of deposits, they are refunded if there are not enough born to fulfill the list for each sex, or they can transfer to another litter, buyer's choice. All of this information however is listed in the very first email that I send as a response to any inquiries. And it's also written in the contract that is signed before any money even changes hands. Personally I think that deposits do not need to be any more than $250 really, no matter the price of the puppies, the lower the deposit the easier it is for the breeder to refund it, although they should not spend that money til puppies arrive anyways LOL!
