Stud owner should only be able to agree or diagree to letting their dog be used as stud and then if letting him stud, decide if they want a stud fee or pick of the litter.

i'll stick to my original comment..whatever the owners agree to,before wittness,signed document by both parties is what the final outcome should be...anyone can make demands concerning their "property",sure it may sound crazy..if the stud owner makes crazy demands..then go elsewhere..not a difficult concept.

Didn't read past the title, so don't know what is said.

I have only owned bitches for breeding for 40 years. Never offered a stud for breeding. The stud owner can make any agreement with the bitch owner at time of breeding.

But if the stud owner is charging a fee and my check clears the bank, I would ask them to kiss my a** if they felt they had any input past that.

Right now I just have males and don't stud them out but if I did I would not expect to have any input other than stud fee or perhaps a puppy if that's what I wanted.  If I was getting a puppy instead of stud fee I would expect second pick, I would think the breeder/bitch owner would get the first pick.

I breed GSD's & Labrador Retrievers,

the man that has the stud dogs and I have an agreement to sell all the pups as pets/companions with limited reg. unless I myself want to keep one or more and I can of course have full reg.

The man breeding the labs taught me a long time ago that when you breed a dog your name is on the paperwork, and the only way to protect your reputation in the dog world is to sell limited reg.
BUT, if the people want to breed their dog in the future they have to do all the health checks that he does, then he will reverse their reg to full.

I can not use his studs if I do not follow his agreement, and he also sets the price for pups, if I sold his pups for less than what he sets for a price and he was to find out, he would not let me use his studs anymore, he also does not co-own any of his dogs,

I also don't pay him a stud fee until the litter is ready to be reg. and a litter consists of 2 or more pups.
I am more than happy with his terms!

 While stud owners may not have any litter rights, they also don't have the responsibility that the breeder has.  Who has to take a pup back because of temperament or health issues or a re-home situation(or if it ends up in a shelter, not being reclaimed by the breeder or owner).  
The breeder picks a stud hoping there won't be an issue with  his genetics that the breeder will have to make right....because the breeders kennel name is standing behind what is being produced.
And a stud owner hopes that the breeder they let use their dog is responsible for the life of all those pups he's produced....in a perfect world!

Puppies being on limited reg does not prevent any owner doing whatever they want if they choose to do it.  You can have the best contract in the world but the owner will breed and then make up some excuse to how it happened. Sorry Mirasmom I don't care how good a dog is no stud owner is going to dictate what I do with my puppies and cetainly what I can and cannot sell them for.  There are always  other options - your man seems a bit controlling for me.

It,s only controling if you are the one breeding with the said stud owner.As mirasmom stated the deal work well for her and the people she sells dogs to, who are we to question that arrangement.
