You can make a person's life pretty miserable with a judgment. You simply have to perfect the judgment: attachments and liens, etc.

I have spent the afternoon researching collecting a judgement. You can bet I will be relentless. If you are innocent the courts do not work. I watched her tell lie after lie (under oath) with no consequence. How could the judge be sure who was telling the truth? He cound not just had to award me what I could prove. You can bet I will go after my money. It would also be helpful to those of us in Texas to move her out of this state. Sometime she is going to run out of places to hide.

I would use the value of the dog for the judgement, and value it less and take another one or 2. You can seize property with a judgement. Name the female as a breeder or male (show dogs with value) as a stud and give the order to the sheriff and go with them. do you have the tatt number? I woud also look into serving her with an order to no allow her to sell off assests. You can do a debtors exam in court, she has to name all assets and give location, and if she no shows this they will put out a warrant for her. You can also do what is called a "till tap", they go to the "register 1 time and clear it. You can also have the marshall sit there all day and any funds she takes in goes to him. set up someone to purchase the dog, give her the funds and have the marshall take the money back. This requires timming, but if you are as mad as I would be, It has been along time since I have done these things, but they are all possible. You can call the sheriffs office and they will explain proceedures and cost of. If she owns a car, and you can find the balance owed on it, it also might be worth having it picked up. I think you can store 30 days and make up your mind to give back or sell but you have to pay the lein holder if sell. IF she leaves the state you can get whats called a "sister judgement" filed in that state. Texas is a nightmare to collect from (debtor state), they use to allow you to keep gun, truck and something else, to many years have gone by. would be empting out her kennel for the funds owed, selling her car for $500. She have a litter coming up. For the ones I took pleasure in getting, I made thier life a living hell, never went for the payoff just slow torture. Most state make you wait 30 days from judgement date to begin to collect. Take your time and learn, might be worh the trip to go into sheriffs and talk to them.

I DO NOT understand the Justice System. If you cheat, steal, and lie, you get off free as a bird. That peroxide cow!!! She ran out of Illinois, and Texas inherited her. Go after her the TEXAS WAY!!
Poor Greta, and the rest of the POOR DOGS that she has! I hope God protects those dogs! HE HAS TO!

I am so emotionally drained. The law is for the guilty. The only thing I can do is make sure no one ever gets involved with this person again. This board has given me a wealth of infomation and I thank all of you who resonded. The only way we can get rid of this crook is to make prospective buyers aware of just exactly what kind of scam she is running

Karama, in a sense (strange and ridiculous as it seems) justice was served. Just like everyone else here I wanted you to spend this Christmas with your dog, and it is surely disappointing to hear the judge's decision. But, he did deliver a verdict in your favour and good luck towards receiving one (1) cent from the defendent.
I doubt that daddy's money got her off the hook this time. I think the judge did what he could-order the defendent to return your money spent so far. I guess he could have ordered the return of the dog and I really think he should have done this. However I do understand that since money was involved that he ordered a monetary judgement. The judge probably has no concept of the value/price of a well-bred GSD.
Not so long ago I had a similar issue with a dirtbag who owed me money and could not keep his word. I paid for a civil warrant-he was served and did not appear for court. I easily won a summary judgement for the full amount plus costs and made sure that he knew about the judgement, but of course there was no action on his part. I paid this person a sincere visit and predicted exactly how his future would change. He obviously discovered that it was in his best interest to pay me and I eventually recieved all of my money.
So, what can you do now? I think you should proceed with the criminal matter and not let anything rest. You should contact the sherriff and see what can be done now that a judgement has been delivered. Tiring? Damn it-I know it is! With my recent situation it would have been so much easier for me to beat a dirtbag on a regular and ongoing basis in order to recieve what was owed, but I don't live like that these days. Age tends to temper one a bit in regards to fisticuffs, but never in regards to justice.
Keep your chin up and damage this person further. The judgement is yours (and public record as well) and you are free to tell the world what happened.

Karama, I'm so sorry for you and your baby. What was the "purported" reason this person "reclaimed" the dog? Did it have anything to do w/ the judge's decision to only award money damages?
Some suggestions if I may. 1. Seriously consider paying a lawyer for advice if not representation. 2. Ask him if Texas allows a claim in equity. It may not because I think it's laws are spanish based rather than English (Grt Britain) based. Even if it does allow claims in equity msot states have merged their law and equity courts but do allow special pleadings in equity. The "law" is a harsh mistress and will generally allow only money damages but equity can frame more compassionate decisions - it is a LITTLE more like truth, justice and fairness -more "equitable". You may be able to make a claim in equity for the return of your property as part of the civil judgement on the A &B, trespass etc. If such a claim is made you would then probably need to get a court order prohibiting her from disposing of the dog before the case is decided. Again seriously consider getting a lawyer. It is the season of good cheer. One might cut you a break or even do it pro bono.
I would also go back to the clerk of the court you were just in and smoosh a bit. (Clerk's are often the best people to know). Bring pictures of your girl - puppy pictures and any current ones. Try to find out if they are an animal person. Be blatant. Bring some holiday brownies as a thank you for getting you on the calender so quickly. Find out if it is possible to get a hearing to ask for a modification of the judge's order today. If he is on vacation and it has to be bumped to another judge see if you can wheedle info about who might be animal friendly. If you do get a chance to ask for a modification I would go in loaded for bear with as many conceivable possibilites you and the board member's can come up with and as much hard evidence to bacl up her previous bad acts ( you should be able to get some in to show "pattern and practice" - PLUS makes sure the DA does this on the criminal side also). Perhaps board members in ILL can get copies of court records, filings, judgements to help you out. Go to Lexis Nexis on the web and pay to use. Great public record db which includes liens, judgements, court filings and tax defaults.
All right to start you out with reasons to request a modification that orders the Def to return the dog to you ( at a minimum until litigation is completed). Point out to the judge is that is the only thing that "will make you whole". Point out as one member suggested that if it were a stolen car the Def would be directed to return it to you - why should a dog be different. Point out to the court that because you are filing criminal charges that the dog is at risk for being abused or killed in retaliation ( if you can document those missing dogs Kershberger mentioned it might help this argument). If this was an anitque silver teapot the court would order it be placed in escrow to prevent destruction so at a minimum he could order the dog to a safe nuetral place ( YR???) or better yet to you because you are willing to post bond certifying the safetly of the dog. Point out to the court that by leaving the dog with her it is enabling the possibility of further fraud on her part- she will resell a dog she doesn't own and can not give proper paperwork for. This is where it would help to have as much solid court info about her previous practies and barring that sworn affadavits by people who have been defrauded by her ( Kershberger could you help get such affadavits - just need to be notarized)

The blondie sent Steve an email , night before last, and was all about telling him how frawley stole the name Leerburg from Lierburg,(Karl) in Germany and how she hates Leerburg. She had a lot to say about Leerburg being a thief...but she neglected to tell him she was one too. She does hers a different way...she stated she has tales to tell about frawley...well , excusea mae me...but I dont think she needs to be carrying around any tales about someone elses thieving....she takes the cake...from looking at the ripoff.com

Judges like for us to do their work for them. So lets make it easy for him. This is where a lawyer could be useful because he could draft a modification order for you. Many judges "orders" are merely orders drafted by one side or the other and adopted by the court.
So forum members - what other grounds can we come up with to request the return of Greta on either a temporary or permanent basis.
Has this person ever been required to register with either a state ag dept or the USDA based on the number of dogs she has? If so what records do they have?
Can any of you help by getting notarized affadavits from previous victims?
Does any one have any Texas connections with either lawyers or sheriffs that could give some advice.
I did really like the idea of declaring the dog as an asset and seizing it as part payment of the judgement ( her value is NOW lower than when you bought her because this person has muddied the ownership picture by the theft and ensuing litigation and it well may cost you to straighten it out with various registries)

karama,Im so sorry for your situation.It must feel terrible for someone to be in your predicament,I dont know what I would do to someone who would dare to come on my property and try to take one of my dogs,no matter what the circumstances,and im only a little guy.One of us would be going to jail and the other or others would more than likely go out in a BB.Anyway,im sorry but it pisses me off to hear some of the stuff that goes on in this breed of ours.Yes ,i also was taken by a breeder in Canada for several thousand dollars but that was a whole different situation which im NOT going to get into.I will say that you have been given VALUABLE suggestions here by many that obviously know what's what(mystere,bob-o,yrt,and the others).I also know that it will be time consuming and probably cost a little as well but you need to either fight all the way for what was done to you OR there is also the option of leaving it the way it is and chalk it up to experiance.That choice is yours and only yours to make.I do wish you the best of luck either way .Its unbeleivable the scum thats involved in this business,and I thought my last 2 businesses were cut throat.Anyway,take care and I hope it all comes together for you.
