VB, 

IF the dog is truely under control and in the owners yard with the owner right there with the dog, I consider that as a dog NOT at large.  That said, part of my previous response was many people have less control then they think or are willing to admit......

All my dogs have quite a bit of OB training.  I have one (she's now 3-years old) that I have to keep on a leash or in a fenced yard.  The only exception is if the tailgate to my van is open, or the dog trailer is ready and open.  If she see's a prey animal, bird, rabbit, you name it, she does a mental shut down and is gone with no calling back (yes e-collars have been tried).........  Because of this she is my house dog, she will not be trialed.  She only goes when she will be on a leash at the other end of the trip.  Even with her training I acknowledge when her prey drive kicks in she would be "at large" in a split second.  She's the one never ever allowed to go to my barns with me...........

I have a feeling this is leading up to a recent problem you've had?

Tina,  You are pretty much correct and I have always respected your posts on DB. I like Sharon am a Conservative when it comes to these issues. I dont take un-necessary chances with dogs.  I dont believe all controlled  dogs should be under house arrest, behind a fence, on a tieout or a leash at all times.  I do believe in limited freedoms along with proper restraints. Tina and Hodie both Im sure youve heard of Dog Owners "being thrown under the bus " simply because of their dog ownership, eg:  we cant get at him so we will go after and complain about his dogs. And the beat goes on. Naturally you can read between the lines this is a next door neighbor dispute between myself and OP.  I was forced to file a complaint over their property condition and did it on May 16.  They come back on July 9 and file one against me for Running at large.  Said incident happened on June 13 never called the Police or AC,  and filed the complaint almost a month later, questionable? Most of my entire Neighborhood has signed a statement backing me up that this does not happen with my dogs, inclusive of 2 local LEO.  I will see how it plays out when I appear on July 29.

VB, I truely wish you the best of luck.   Please give an update when you can.  Neighbors scare me............

A friend is having a similar problem, neighbors claiming one specific dog has been coming to their house even though the dog is now living two states away........

Off my property and not under my direct control. They shoot loose pets here too, just for fun.

Unfortunately, human nature being what it is, yes, if you file against someone about something, however legitimate, you may well expect a complaint to be filed against you for something. This is the pettiness of humanity showing through. Hopefully, your neighbors signatures on a statement attesting that your dogs don't run at large will assist in having the complaint simply thrown out and the judge seeing the complaint for what you suggest it is, retribution. And, if the judge believes the complaint against you is false and filed as a "payback", I hope he throws the book at the people for that.

i was fined and paid for my late nenz  "running at large" when he nipped the upstairs neighbor as she came into our shared yard. he was off-leash in the yard and after ( i found out later) months of her hitting him with a stick as he was tied outside, he finally nipped her. my personal definition would be, running around on public property with no owner in sight. obviously, my city and i disagreed.
